There needs to be a policy to develop and improve the quality of civil servants in ethnic minority areas.

Giving opinions on the Draft Law on Civil Servants (amended), delegate Cao Thi Xuan (Thanh Hoa delegation) suggested that it must be consistent with the Party and State's ethnic policies and guidelines, contributing to building, developing and improving the quality of civil servants in ethnic minority areas.

On the morning of November 13, speaking at the discussion hall on the Draft Law on Civil Servants (amended), delegate Cao Thi Xuan expressed her strong agreement on the need to amend and supplement the Law. Basically, she agreed with the contents of the draft, however, the Drafting Committee needs to continue researching to have policies and regulations related to the issues of regions, ethnic minorities, monitoring mechanisms, etc.

The law has not yet fully institutionalized regional issues and ethnic policies.

Specifically, delegate Cao Thi Xuan mentioned policies on building and developing a team of civil servants (Article 6 of the draft), Clause 1 of Article 6 stipulates: "The State has policies on building and developing a team of civil servants with professional ethics, qualifications and professional capacity appropriate to each industry and field".

The delegate said that through monitoring the implementation of the National Target Programs on new rural construction, poverty reduction and socio-economic development in ethnic minority and mountainous areas; the results of the thematic monitoring of "Implementation of policies and laws on human resource development and use", the thematic monitoring of "implementation of policies and laws on innovation of the organizational and management system, improving the quality and efficiency of SNCL units in the period 2018 - 2023" ... showed that: In mountainous areas, ethnic minority areas, areas with particularly difficult socio-economic conditions, the issue of human resources is always among the shortcomings and difficulties in implementing policies and laws of the Party and the State. In particular, human resources in the fields of health and education are always lacking and weak; human resources in essential and basic public service fields ...

From the perspective and analysis, according to delegate Cao Thi Xuan, the new draft Law only focuses on the suitability for each industry and field, but has not fully institutionalized the issues of regions, ethnic policies of the Party and State in the issue of human resources, that is, the team of civil servants; it is not suitable and compatible with the regulations on the policy of developing public service units in Article 5 of the draft Law when we focus on investment resources but lack human resources.

Besides, the remaining policies in Article 6 have not yet reflected the issue of building and developing a team of civil servants who are ethnic minorities and civil servants working in ethnic minority areas, mountainous areas , and areas with especially difficult socio-economic conditions.

"We all know that this is an issue that the Party always cares about and the State always ensures. Therefore, I suggest that the drafting agency continue to research and supplement the assessment content to perfect the relevant provisions of the draft Law, ensuring consistency with the Party and State's ethnic policies and guidelines, contributing to building, developing and improving the quality of civil servants in ethnic minority areas," the delegate said.

Need a strict monitoring mechanism to avoid the consequence of main tasks becoming secondary tasks.

Article 13 of the draft law stipulates that civil servants are entitled to sign contracts to carry out professional activities and business activities. Delegates expressed their agreement because they believe that these are regulations aimed at taking advantage of the capacity and professional experience of civil servants in their professional activities to contribute to society, especially in jobs requiring high expertise in the fields of health and education, while at the same time, increasing legitimate income for civil servants.

However, the delegate also pointed out that, compared to the current law, the draft law (amended) has expanded rights, more specifically the rights, but seems to lack strictness in ensuring the principle of completing all tasks and responsibilities of a state official before participating in outside work.

"In other words, without a strict monitoring mechanism, the consequence could be that the main task becomes secondary and the quality of essential basic public services is not guaranteed," the delegate expressed...

On that basis, delegate Cao Thi Xuan suggested that the drafting agency "carefully review to supplement regulations to avoid the risks mentioned above and, if necessary, assign the Government to provide detailed regulations so that there can be more time to calculate the measures to be built to ensure feasibility, effectiveness and efficiency in managing the civil servant team".
