Some cases of artists violating advertising regulations will be handled.

NDO - In the coming time, the authorities will strengthen the detection and handling of samples, handle some cases of artists and public figures who advertise falsely according to existing regulations, limit the images and products of violators in the press, performance stages and cyberspace. That is the information given at the regular press conference of the Ministry of Culture, Sports and Tourism on the afternoon of April 21 in Hanoi.

According to Mr. Le Quang Tu Do, Director of the Department of Radio, Television and Electronic Information, currently, in legal regulations, there is no separate group of regulations nor any group of regulations requiring the application of stronger measures or additional penalties for artists and celebrities who advertise falsely.

The current handling is based on current Vietnamese legal regulations, which apply to all subjects. It is expected that the upcoming draft of the Law on Advertising (amended) will add some contents to tighten management of advertising activities related to celebrities and public figures.

Regarding sanctions against celebrities who violate the law, Mr. Le Quang Tu Do said: The Ministry of Information and Communications (formerly) issued a Code of Conduct on Cyberspace, and encouraged ministries and sectors to jointly develop codes in each field. However, this code does not have accompanying sanctions, so it is not a deterrent.

The Ministry of Information and Communications (formerly) has also institutionalized some contents in the code of conduct and regulations on the management, provision and use of internet services and online information. These contents are also proposed and institutionalized in the draft Law on Advertising (amended) submitted to the National Assembly in May... At that time, there will be a legal basis and sanctions to punish artists or celebrities who advertise falsely or violate advertising.

Some cases of artists violating photo advertising will be handled

Mr. Le Quang Tu Do shared: The Ministry of Information and Communications (previously) coordinated with the Ministry of Culture, Sports and Tourism to develop regulations to limit the appearance of images and performing arts products of people working in the art field in the press, on cyberspace, and on performing arts stages for artists who have violated the law...

However, in the past four months, no cases have been handled under this regulation. It is expected that in the coming time, the authorities will increase the detection and handling of samples, and handle some cases of false advertising.


Providing more information about artists and celebrities who advertise in violation, Deputy Director of the Department of Radio, Television and Electronic Information Nguyen Thi Thanh Huyen said that recently, the Department of Radio and Television has received many reports from press agencies related to the situation of some individuals on the internet advertising milk and nutritional products with false information. Through the process of inspection and verification, the Department has coordinated with the Department of Food Safety (Ministry of Health) to inspect, verify and handle the violating advertisements.

Specifically, the Department has coordinated to handle the case of editor Quang Minh and MC Van Hugo participating in advertising a milk product that does not match the product content announced to the authorities as well as does not match the documents provided by the brand...

Accordingly, after the working session on April 18, the Department of Radio, Television and Electronic Information drew up a working record and a handling record, with the expected fine for editor Quang Minh being 37.5 million VND, including two violations: advertising inconsistent with the prescribed documents (Point a, Clause 2, Article 52, Decree 38/2021/ND-CP dated March 29, 2021, stipulating administrative sanctions in the field of culture and advertising) and advertising using the name of a doctor in the advertisement (Point a, Clause 4, Article 52, Decree 38/2021/ND-CP dated March 29, 2021, stipulating administrative sanctions in the field of culture and advertising).

For MC Van Hugo, the expected fine is 70 million VND, violating regulations related to advertising that causes confusion about product quality and uses, (according to Clause 5, Article 34, Decree 38/2021/ND-CP Decree 38/2021/ND-CP dated March 29, 2021 regulating administrative sanctions in the fields of culture and advertising).

From the two cases mentioned above, Ms. Nguyen Thi Thanh Huyen emphasized: The common violations today are advertising beyond the use, causing confusion about the use and quality of the product. Celebrities in particular and those participating in advertising in general need to learn from experience. When receiving a brand advertising contract, it is necessary to carefully check the related licenses and advertising content, avoid exceeding the use, features as well as providing false information about the ingredients of the product...
