In order to promptly adjust the coordination method between prosecution agencies in the new situation, on February 27, 2025, the joint agency of the Ministry of Public Security - the Supreme People's Procuracy - the Supreme People's Court signed Joint Circular 02.
The Circular provides specific regulations on the coordination mechanism between competent agencies in criminal proceedings, management, temporary detention, temporary imprisonment and execution of criminal sentences in the context of no longer having district-level police organizations. This document officially takes effect from March 1, 2025, creating an important legal corridor for localities to implement uniformly.
Specify responsibilities and methods of information exchange
Director of the Provincial People's Procuracy Pham Trung Thuan said: After Circular 02 came into effect, to ensure that criminal proceedings take place continuously, in accordance with the law, and in response to practical situations, the Provincial People's Procuracy and the Provincial Police held a conference to sign a coordination regulation in the work of receiving, classifying, and handling denunciations, reports of crimes and recommendations for prosecution; investigating criminal cases against investigators and investigation officers assigned to commune-level police. This coordination regulation consists of 3 chapters and 12 articles, specifically regulating the responsibilities, principles, and methods of exchanging information and documents between the two branches.

To effectively implement this coordination regulation, the leaders of the Provincial People's Procuracy request the heads of the People's Procuracies of districts, towns, and cities and the leaders of the Department of Prosecution, Investigation, and Trial of Criminal Cases (Provincial People's Procuracy) according to the functions and tasks of the unit to urgently organize dissemination, synchronous and effective implementation.
The coordination process must be carried out on the principle of respecting each other's duties and powers; ensuring good performance of local political tasks. At the same time, heads of units and chief prosecutors of local People's Procuracies must strictly implement Directive 04 dated March 24, 2025 of the Supreme People's Procuracy on streamlining the apparatus and key tasks of the Procuracy sector; strictly implement and closely coordinate with the Investigation Police Agency (IPA) of the Provincial Public Security and the communal police to well perform their functions and tasks according to the Party's policies, the National Assembly's resolutions and the sector's directions, not to interrupt, overdue or miss tasks or cases being handled. The review, statistics, and cataloging of records and documents of cases, especially cases that are temporarily suspended or suspended, must be carried out seriously and fully.
"The policy of not organizing district-level police is a new one, leading to many changes in the structure and coordination of tasks between units. Difficulties and problems may arise during the implementation process, so units need to uphold their sense of responsibility and proactively coordinate to resolve them. If they cannot reach an agreement, they must promptly report to superiors for guidance," Mr. Pham Trung Thuan emphasized.
Promoting the important role of communal police
According to Colonel Vo Duy Tuan, Deputy Director and Head of the Provincial Police Department of Investigation, the signing of this coordination regulation marks an important change in the thinking and practice of crime prevention. Accordingly, each source of information and crime denunciation is received promptly and quickly processed according to the correct procedure, ensuring that there is no omission or overdue situation.
When the district-level police organization no longer exists, the role of the commune-level police force is significantly enhanced. The commune police directly receive information about crime denunciations, report to the provincial-level police investigation agency, and at the same time participate in verification activities, collect evidence, and support initial investigations.
The removal of district-level police is a major step in the reorganization of the administrative apparatus, but it also poses many challenges. Phu Yen is proactively and actively implementing many synchronous and flexible solutions to ensure effective litigation activities, contributing to maintaining legal discipline and local social order and safety.
In addition, the commune police also have the task of supervising people serving non-custodial reform sentences in the community, people released from prison early on conditional terms, and implementing population management according to regulations... As a force that controls the area, the commune police play a very important role in crime prevention, contributing to maintaining security and order at the grassroots level.
