On the afternoon of June 3, reporting at the meeting of the National Assembly Standing Committee (NASC) on the reception, revision and completion of the draft Law on Organization of Local Government (amended), Minister of Home Affairs Pham Thi Thanh Tra said that, receiving opinions from National Assembly deputies, the Government has revised and completed the regulations to ensure the clear establishment of a 2-level local government organization model (provincial and communal levels); at the same time, adding a number of criteria to clarify the regulations on special administrative- economic units to distinguish them from special zones; adding a number of principles in the organization and operation of local governments to be streamlined, efficient, effective, efficient, close to the people, serving the people...
Regarding the division of authority, decentralization, delegation, and authorization, the Minister of Home Affairs emphasized that the draft law clearly defines the authority between the People's Council and the People's Committee; the collective People's Committee and the individual Chairman of the People's Committee at the provincial and communal levels; and at the same time establishes a proactive, flexible, and creative management mechanism in the organization and implementation of local authorities.
The Government proposes to empower local authorities to proactively resolve issues related to two or more administrative units, in order to minimize the situation of shifting responsibility to higher levels and improve operational efficiency at the commune level.
The draft amended law also adds provisions on the subject of the provincial People's Council being decentralized to the People's Committee of the same level and the People's Council of the commune level, to ensure compliance with the provisions of current laws and current practices of localities; adds the decentralized authority of the Chairman of the provincial People's Committee to be consistent with the assigned tasks and powers.
Regarding the tasks and powers of local authorities, Minister Pham Thi Thanh Tra informed that the draft law has completed the content of the distinction between the general tasks and powers of the People's Committee and the specific tasks and powers of the Chairman of the People's Committee in the direction of increasing the authority of the Chairman of the People's Committee.
Accordingly, the provincial People's Committee has 12 tasks and powers; the provincial People's Committee chairman has 23 tasks and powers; the commune-level People's Committee has 10 tasks and powers; the commune-level People's Committee chairman has 17 tasks and powers. Meanwhile, the current law stipulates that the provincial People's Committee chairman has 15 tasks and powers.
To enhance the role and personal responsibility of the Chairman of the People's Committee, the draft law also adds a provision that the Chairman of the People's Committee is authorized to decide on behalf of the People's Committee on matters under the authority of the People's Committee and report to the People's Committee at the nearest meeting, except for matters that the Law stipulates that the People's Committee must discuss collectively and decide.
Presenting the viewpoint of the Committee on Law and Justice, Chairman of the Committee on Law and Justice Hoang Thanh Tung said that the Standing Committee of the Committee agrees with the revision of regulations on tasks and powers of local authorities at all levels in the direction of more clearly defining the authority between the Chairman of the People's Committee and the collective People's Committee as proposed by the Government.
However, Chairman of the Law and Justice Committee Hoang Thanh Tung noted that decentralization must be stipulated in legal documents of the decentralizing agency or individual. Therefore, the examining agency proposed to add to the Law on Promulgation of Legal Documents the authority of the Chairman of the Provincial People's Committee to promulgate legal documents to ensure consistency and feasibility.
