Creating "push, lever, fulcrum" for the private economic sector

The Government Office issued Notice No. 221/TB-VPCP dated May 9, 2025 Conclusion of the Government Standing Committee at the working session on drafting a National Assembly Resolution on private economic development.

In the Notice, the Government Standing Committee highly appreciated the efforts of the Ministry of Finance in developing and submitting to the Politburo for promulgation Resolution No. 68-NQ/TW dated May 4, 2025 on private economic development (Resolution 68) with many profound, comprehensive, specific proposals, directly approaching important issues that need to be focused on solving.

Submit to the National Assembly special mechanisms and policies for private economic development at the 9th Session

The Government Standing Committee requested the Ministry of Finance to preside over and coordinate with relevant ministries and agencies to urgently review and complete the submission to competent authorities to submit to the National Assembly at the 9th session of the 15th National Assembly to issue a Resolution on specific, specific, especially feasible and effective mechanisms and policies to fully and promptly institutionalize the guidelines and policies as well as implement the goals stated in Resolution 68; at the same time, promptly issue the Government's Action Plan to serve the organization of dissemination and implementation of Resolution 68.

The Government Standing Committee basically agrees with the proposal of the Ministry of Finance on grouping tasks and solutions in Resolution 68 to institutionalize the contents under the authority of the National Assembly:

(1) The group of contents that need to be institutionalized immediately, included in the draft Resolution of the National Assembly to be submitted for promulgation at the 9th Session for tasks that are clear, important, urgent, have not been institutionalized or need to be amended under the authority of the National Assembly, not within the scope of group (2).

(2) Group of contents that need to be added to the Law projects being submitted to the National Assembly for approval at the 9th session for tasks within the scope of regulation of a number of Laws already included in the law-making program for approval at the 9th session of the 15th National Assembly.

(3) The group of contents on tasks and solutions of an orientational nature needs to be focused on, carefully evaluated to propose to the National Assembly for amendments in the coming time, it is necessary to focus on studying, absorbing the opinions of the Supreme People's Court, the Supreme People's Procuracy at the meeting, carefully reviewing to institutionalize the orientations, principles of perfecting the law or into specific, clear regulations to be included in the draft Resolution of the National Assembly according to the above group 1 to be submitted to the National Assembly for promulgation at the 9th Session for immediate application, at the same time creating a basis for the Ministries and branches to continue to institutionalize into related Laws in the coming time, ensuring full institutionalization of guidelines and policies in Resolution 68 right at the 9th Session (including the principle of clearly distinguishing criminal responsibility from administrative and civil; between legal entities and individuals in handling violations; between criminal and non-criminal, resolutely not criminal).

Create conditions for business households to become enterprises

The Government Standing Committee requested the institutionalization of policies and guidelines in Resolution 68 and the development of an Action Plan that should focus on prioritizing necessary, important, urgent contents that are most expected by businesses and people, must be done immediately without requiring many resources, and can be handled immediately to create "pushes, levers, and fulcrums", bringing about great impacts and efficiency, truly removing obstacles, creating new motivation, liberating resources, and productivity of the private economic sector; achieving the goal of having 2 million enterprises and at least 20 large corporations participating in the global multinational value chain by 2030; emphasizing the following key contents:

- Administrative procedures must be quick, simple, easy to implement, and cost as little as possible, especially for procedures for business establishment, dispute resolution, and bankruptcy.

- There are breakthrough policy mechanisms to promote business development, including encouraging and creating conditions for business households to become enterprises; small enterprises to become large, large enterprises to become larger; fully ensuring ownership rights, property rights, freedom of business rights, and equal competition rights of the private economy.

- Promote and effectively apply the public-private partnership model, focusing on accelerating the models of "public leadership - private governance", "private investment - public use", "public investment - private management".

- Strengthen decentralization for ministries, branches and localities in ordering works and projects for private enterprises to implement according to the principles of ensuring progress, quality, no capital increase and no corruption, waste, negativity, group interests, associated with strengthening supervision and inspection.

- Specify and institutionalize the policies and orientations in Resolution 68 on compliance with the principle of clearly distinguishing criminal, administrative and civil responsibilities; between legal entities and individuals and related issues in handling violations.

- Policies on taxes, fees, charges and other related policies must be clearer, more detailed and more favorable to encourage business development; further research and evaluation of contents with long-term impacts...

In May 2025, the Government's Action Plan to implement Resolution 68 will be issued.

The Government Standing Committee assigned the Ministry of Finance to preside over and coordinate with relevant agencies to maximally absorb the opinions of the Deputy Prime Ministers and the ministries and agencies attending the meeting, the opinions of the members of the Prime Minister's Policy Advisory Council at the meeting on May 8, 2025 and the above instructions to continue to complete the draft Resolution of the National Assembly and the Action Plan, urgently collect opinions from relevant ministries, branches, localities, members of the Prime Minister's Policy Advisory Council, and Associations, business community, VCCI no later than May 9, 2025.

Synthesize and absorb opinions, complete the dossier of the National Assembly Resolution according to regulations, send it to the Ministry of Justice for appraisal, synthesis, and submit it to the Government according to regulations no later than May 12, 2025 to carry out procedures to request opinions from Government members for approval to submit to the National Assembly for consideration and promulgation before May 18, 2025. The submitted dossier must clearly explain the political, legal, practical bases, reasons for the mechanisms and policies that need to be included in the National Assembly Resolution; the contents that need to be included in specialized Laws to institutionalize Resolution 68.

At the same time, the Ministry of Finance synthesizes and completes the Government's Action Plan to implement Resolution 68; ensuring "6 clarity: clear people, clear work, clear time, clear responsibility, clear products, clear results"; submit to the Government before May 12, 2025 to complete procedures to request comments from Government members, in time to issue before May 16, 2025.

The Government Standing Committee assigned the Ministries of Finance, Home Affairs, Science and Technology, Justice, and the State Bank of Vietnam to preside over and coordinate with the Ministry of Finance and relevant agencies to urgently review and supplement necessary contents to institutionalize the tasks and solutions related to Resolution 68 into the draft Laws and Resolutions submitted by the Ministries and agencies to the National Assembly for approval at the 9th Session of the 15th National Assembly (including the Law on Cadres and Civil Servants, the Law on Bidding, the Law on Investment under the Public-Private Partnership model, the Investment Law, the Law on Public Investment, the Law on Corporate Income Tax, the Law on Science, Technology and Innovation, the Law on Digital Technology Industry, the Law on Handling of Administrative Violations, and the Law on Credit Institutions). The Ministry of Finance continues to review and proactively coordinate with relevant ministries and agencies to fully and promptly institutionalize the related tasks in Resolution 68 into the draft Laws being submitted to the National Assembly for approval at the 9th Session. The Ministry of Justice conducts appraisal of the National Assembly's Resolution dossier, ensuring quality and deadline for submission to the Government according to regulations.

The Government Standing Committee assigned the Government's media agencies (VTV, VOV, Vietnam News Agency), the Government Office (Government Electronic Information Portal) and relevant ministries and agencies to focus on promoting policy communication on private economic development according to the Resolutions of the Politburo, the National Assembly and the Government's Action Plan.
