(Chinhphu.vn) - The Minister of Home Affairs affirmed that he will review and revise the draft Law on Civil Servants (amended) to create maximum conditions for civil servants in their professional activities, while ensuring transparency, preventing conflicts of interest and policy exploitation.

Minister of Home Affairs Do Thanh Binh clarified some issues of concern to National Assembly deputies.

On the morning of November 13, discussing in the hall about the draft Law on Public Employees (amended), National Assembly deputies basically agreed with the content of the draft law; assessed that the draft law has many innovative and creative points, meeting the requirements of modern and effective management; at the same time promoting the role of management agencies, public service units and the capacity, strengths and intelligence of civil servants in serving the people.

Delegates gave detailed comments on the content, structure and legislative techniques, deepening the issues raised, ensuring the draft law is of high quality, consistent and feasible when put into practice.

Explaining before the National Assembly, Minister of Home Affairs Do Thanh Binh respectfully thanked the delegates for their dedicated and responsible opinions.

He said that immediately after the meeting, the drafting agency will coordinate with the National Assembly's Committee on Law and Justice and the National Assembly Office to fully synthesize and absorb all opinions to revise and perfect the draft, ensuring quality and progress before submitting it to the National Assembly for consideration and approval.

At the discussion session, some delegates proposed not to regulate the content on organization and operation of public service units in Article 5 of the draft, but to let the Law on organization and operation of public service units regulate.

Minister Do Thanh Binh said this is also an issue that the Government has carefully considered. The Law on Public Employees mainly regulates the recruitment, use, and management of public employees, while the organization of public service units is a matter of organizational structure.

However, current regulations in Articles 9 and 10 of the 2010 Law on Public Employees, amended and supplemented in 2019, stipulate that public service units serve as a basis for the Government to regulate the organization and operation of public service units.

Therefore, during the time the Law on organization and operation of public service units has not been promulgated, the Minister proposed that the National Assembly keep the provisions in Article 5 of the draft Law to serve as a basis for sub-law documents to be promulgated and maintain stability in the operation of public service units.

Innovation in management mechanism and use of civil servants according to job positions

Many delegates are interested in innovating the management mechanism and using civil servants according to job positions - considered the center of recruitment, use, evaluation and classification of civil servants. The Minister of Home Affairs said that he will review and complete regulations related to the basis, principles, methods of recruitment as well as salary policies, bonuses and other regimes related to job positions.

Regarding the authority to recruit civil servants, the Minister said that at this session, the Government also submitted to the National Assembly a draft Resolution on a number of specific and outstanding mechanisms and policies to make breakthroughs in the development of education and training, including regulations on the authority to recruit civil servants who are teachers, and at the same time stipulates that in case there is a difference in the same content between this resolution and the law, the provisions of the resolution will apply, so the specific regulations for teachers will be implemented according to the provisions of this resolution.

For other contents, the drafting agency shall coordinate with the reviewing agencies to ensure consistency between the draft law and the provisions of laws on specialized civil servant management.

One content that has received much attention is allowing civil servants to sign labor contracts or professional service contracts with agencies and organizations outside the public service unit where they work.

Delegates were generally in agreement that this provision would help create a mechanism for connecting human resources between the public and private sectors, while also creating conditions for civil servants to increase their legitimate income. However, many opinions suggested that there should be a specific mechanism to ensure that civil servants complete their assigned tasks well, avoiding conflicts of interest or taking advantage of policies.

In response to comments, the Ministry of Home Affairs will review, adjust, and ensure principles to create maximum conditions for civil servants in their professional activities, but at the same time must ensure transparency, avoid conflicts of interest and policy exploitation.

Building a team of professional civil servants to better serve the people

Regarding the evaluation and classification of civil servants, delegates emphasized the need for substantive, objective, multi-dimensional evaluation, linked to work products and results. The Ministry of Home Affairs will absorb and adjust so that the evaluation is carried out regularly and continuously, based on the quality of public career services and the level of people's satisfaction; at the same time, apply digital technology, build a national database of civil servants, ensuring publicity and transparency.

In addition to the above contents, the drafting agency will also receive comments on discipline, training, fostering, emulation, rewards, exemption from responsibility, retirement, termination of employment and other rights and obligations of civil servants, in order to build an increasingly professional and effective team, meeting the requirements of serving the people in the new period.
