In his opening speech, Deputy Minister of Justice Nguyen Thanh Tu said that, implementing the direction of the General Secretary on the development of the Project "Perfecting the structure of Vietnam's legal system to meet the requirements of national development in the new era", over the past 3 months, with the coordination of experts, scientists and ministries and branches, the Ministry of Justice has developed a draft of the Project.
The draft Project consists of 3 parts, including general issues on the structure of the legal system; international experience in designing the structure of the Vietnamese legal system; assessment of the current status of the structure of the Vietnamese legal system; achievements in building and perfecting the structure of the Vietnamese legal system; limitations and inadequacies of the structure of the Vietnamese legal system in response to the requirements of national development in the new era; context, viewpoints, goals, and solutions to perfect the structure of the Vietnamese legal system to meet the requirements of national development in the new era; list of legal documents...
Deputy Minister of Justice Nguyen Thanh Tu asked delegates representing ministries and branches with functions and tasks in the fields of culture, education , management and social development to focus on exchanging and discussing general contents and practical issues in their management fields; to propose solutions, proposals, recommendations... to help the Ministry of Justice to best complete the draft Project.
At the working session, Dr. Nguyen Van Cuong, Director of the Institute of Strategy and Legal Science, Ministry of Justice, informed some basic contents of the draft Project "Perfecting the structure of Vietnam's legal system to meet the requirements of national development in the new era" in the fields of culture, education, management and social development; draft Research Report.
According to Dr. Nguyen Van Cuong, there have been a number of Resolutions outlining guidelines and policies in the cultural field; the draft documents of the 14th Party Congress and 10 Laws also regulate this field, but they are not enough. Dr. Cuong gave an example: recently, the Minister of Culture, Sports and Tourism reported that he would develop a Law on cultural industry. However, if we only talk about the Law on Cultural Industry, it is still very general.
In addition, this Law needs to clearly demonstrate the role and responsibility of the State in promoting cultural development because the State's role in creating the cultural sector is extremely important. "Korea's achievements in the cultural industry today are clearly demonstrated by the role of the State in developing the cultural industry. Therefore, if we want to promote the cultural industry and promote cultural development, Vietnam needs to make specific calculations," Dr. Nguyen Van Cuong emphasized.
Regarding the field of education, according to Dr. Nguyen Van Cuong, it is expected that there will be a general law called the Law on Education, followed by a series of specialized laws. The Ministry of Education and Training has just proposed to continue amending and supplementing the Law on Higher Education and the Law on Vocational Education, but it is necessary to add more. Because according to the development process, the field of education law will have specialized laws, specific laws and needs to have laws to encourage private education. In addition, it is necessary to build more laws on education for people with disabilities, laws on lifelong education, laws on lifelong learning, etc.
Regarding labor and social security, the Labor Code will be built as a general law, the fundamental law of the labor field. Regarding social security, the Social Insurance Law is general, social security laws are specific or consider promulgating the Social Assistance Law...
Dr. Nguyen Van Cuong suggested that ministries and branches continue to contribute opinions on the contents of their management fields; determine which laws of their ministries and branches will be considered the general laws of that field; which laws are specialized laws and the characteristics of those general laws...
At the meeting, the representative of the Ministry of Culture, Sports and Tourism said that there are 424 documents related to the cultural field. Of which, there are 13 laws, 77 decrees, the rest are decisions, circulars...
Agreeing on the need to perfect the legal system structure, this representative said that next year the Ministry plans to submit a law amending many laws: Law on Tourism, Law on Cinema...; at the same time, he raised the question of whether building laws in the direction of framework laws and specific laws can limit sub-law documents...
The representative of the Ministry of Home Affairs agreed with the solutions proposed in the draft Research Report. Regarding the field of labor, the Ministry of Home Affairs agreed with the orientation of defining the Labor Code as the general law, then the specialized laws: Law on Employment, Law on Vietnamese workers working abroad under contracts, etc.
Regarding the field of social insurance, according to the representative of the Ministry of Home Affairs, if the Law on Social Insurance is determined to be a general law compared to other laws such as the Law on Health Insurance and the Law on Children, is it necessary to amend the Law on Social Insurance to make it general and comprehensive for other fields?
Concluding the working session, Deputy Minister of Justice Nguyen Thanh Tu hoped that the Ministries and branches would continue to research and give opinions on the draft Research Report, helping the Ministry of Justice have an overview and complete the draft Project.
