US federal appeals court restores Trump's tax policy

A US federal appeals court has temporarily reinstated President Trump's global tariffs.

RT reported that the US Federal Court of Appeals on May 29 temporarily restored President Trump's global tariffs, stopping the Court of International Trade's previous ruling that blocked the tariffs and said that Mr. Trump had exceeded his authority.

Thus, the reciprocal tariffs announced by Mr. Trump on April 2 remain in effect, at least until June 9.

"Plaintiffs and defendants must respond to the US's delaying moves by June 5. The US may file a single reply by June 9," the Court of Appeals said.

On May 29, the Manhattan-based Court of International Trade ruled to block the implementation of tariffs that President Trump imposed last month, saying that the White House boss exceeded his authority by imposing a blanket tax on imports from many countries around the world .

The court also blocked a series of separate tariffs that the Trump administration has imposed on China, Mexico and Canada since he returned to the White House.

The court held that the US Constitution gives Congress the exclusive power to regulate trade with other countries, and that the President's emergency power to "protect the economy " cannot override this power.

However, just minutes after the ruling was issued, the Trump administration filed an appeal.

Peter Navarro, one of Mr. Trump’s top advisers, told reporters on May 29 that the White House was prepared to take the case to the Supreme Court if necessary.

The May 28 ruling does not affect tariffs that Mr. Trump has imposed under other laws, including Section 232 of the Trade Expansion Act of 1962, which sets out 25% tariffs on foreign cars, steel and aluminum.

President Trump also maintained authority under Section 122 of the Trade Act of 1974 to impose tariffs of up to 15% for 150 days on countries with which the United States has a large trade deficit.

In April, the Trump administration imposed a 10% base tariff on all imports, with higher tariffs on China, Mexico, Canada and EU member states, citing trade imbalances. Some tariffs were later suspended amid ongoing negotiations.
