From January 1, 2025, drivers of commercial transport vehicles and passenger vehicles with 8 seats or more must not drive more than 10 hours per day and no more than 48 hours per week.
Recently, the Ministry of Public Security has issued Circular No. 71/2024 regulating the management, operation and use of data management systems for journey monitoring devices and driver image recording devices.
Notably, Circular No. 71 stipulates that drivers of commercial transport vehicles and passenger vehicles with 8 seats or more must not drive more than 10 hours per day and no more than 48 hours per week.
Specifically, Article 13 of Circular No. 71 stipulates the responsibilities of drivers of commercial transport vehicles, passenger vehicles with 8 seats or more (excluding the driver's seat) for commercial transport, tractor-trailers, ambulances and rescue vehicles, as follows:
Responsible for managing journey monitoring devices and devices that record images of drivers during assigned driving hours.
Comply with driving time regulations in Clause 1, Article 64 of the Law on Road Traffic Order and Safety. Driving time of car drivers shall not exceed 10 hours/day and not exceed 48 hours in a week; driving continuously shall not exceed 4 hours and ensure relevant regulations of the Labor Code.
Promptly notify transport businesses and vehicle owners when the journey monitoring device or driver image recording device is not working or disconnected.
Vehicle tracking device data system and driver image recording device
The Circular also regulates the data system of journey monitoring devices and driver image recording devices, including: identification data, journey data, and driver image data.
Identification data includes: Name of transport business unit, tax code, name of transport business license issuing agency, vehicle license plate, number of people allowed to carry the vehicle or load allowed for the vehicle to participate in road traffic, type of business.
Trip data includes: License plate number, driver's license number, speed, time, coordinates and this information is continuously updated.
Driver image data includes: License plate number, driver's license number, speed, time, coordinates, driver image and this information is continuously updated.
Travel data and driver image data from the service server are transmitted according to the message structure specified in Appendix I attached to this Circular to the server of the Traffic Police Department within no more than 2 minutes for travel data and no more than 5 minutes for driver image data, from the time the service server receives the data.
In case of interruption of the transmission line, within no more than 5 days, both old data and current data must be sent simultaneously when the transmission line is operating normally and must have the approval of the Traffic Police Department.
Old data is transmitted on a separate channel, independent of the current data channel. After the old data retransmission period expires, the system will recalculate all parameters.
