On May 16, at Ho Chi Minh City University of Education, the Ministry of Education and Training held a workshop to collect opinions on the drafting of a Government Decree amending and supplementing a number of articles of Decree 04/2021/ND-CP and Decree 127/2021/ND-CP regulating sanctions for administrative violations in the field of education.

According to Dr. Mai Thi Anh, Director of the Legal Department, Ministry of Education and Training, starting from May 31, the inspection system in all ministries (except the Ministry of National Defense and the Ministry of Public Security ) will cease to operate. This means that the Departments of Education and Training and schools across the country will no longer have their own inspection departments.

Ms. Mai Thi Anh commented that this could cause certain difficulties in school administration and state management ofeducation .

According to the direction of the Government and the Draft Law on Administrative Violations, although not directly responsible, the Decrees on penalties will be developed and submitted for promulgation by ministries and branches. The direct responsibility for inspection, examination and penalties will be transferred to the Government Inspectorate. From June 1, the Government Inspectorate will officially perform this task in the field of education.

However, the Director of the Legal Department also clarified that the Departments of Education and Training and specialized departments, even though they no longer have an inspection department, still have the right to draw up records of administrative violations during the inspection process according to their professional functions.

Ms. Mai Thi Anh emphasized the importance of the staff and teachers in the education sector seriously studying and making recommendations on problems arising from current decrees during the implementation process.

She recommended that comments should be sent to the drafting committee for timely revision, to avoid the situation where comments are not paid attention to when the draft is requested, and only when the law has been issued and problems arise do comments come up.

A representative of the Department of Education and Training of Binh Phuoc province expressed concerns about the process of making penalty records of specialized inspection teams, and at the same time requested the Ministry of Education and Training to provide specific instructions on this issue as well as on the arrangement and organization after the inspection department at the units stopped operating.

Deputy Minister of Education and Training Nguyen Van Phuc admitted that after many years of implementation, the current Decree has revealed many points that are no longer suitable to practical changes in education, so amendment is extremely necessary.

The Deputy Minister suggested that the workshop focus on identifying inappropriate and unsuitable regulations that need to be adjusted; propose adding newly discovered violations in practice, loopholes in practice that are still overlooked, and that cannot be handled without regulations and sanctions.

In addition, the workshop also needs to assess the appropriateness of the forms of sanctions, levels of sanctions and remedial measures for violations; consider the consistency and compatibility of relevant documents inside and outside the industry.

Previously, on May 7, in Hanoi, the Government Inspectorate had a working session with the Ministry of Education and Training to receive and hand over the Inspectorate of the Ministry of Education and Training to the Government Inspectorate.
