Son Hai Group's protest against the bidding results: Binh Phuoc talks about the certificate of the expert team leader

(NLDO) - The "failed bid" enterprise reflects that the practice certificate of the Head of the consulting and bidding expert team for the highway project has expired.

On May 28, the Binh Phuoc Provincial Construction Investment Project Management Board informed that the case of Mr. Vu Ngoc Tru, Head of the Bidding Expert Team related to the consultancy on selecting a contractor for the Ho Chi Minh City - Thu Dau Mot - Chon Thanh Expressway project (section through Binh Phuoc province) using a practice certificate that expired in early October 2023 was inaccurate.

According to the Binh Phuoc Province Construction Investment Project Management Board, Mr. Tru's practice certificate was issued in 2023, valid for 5 years, meaning it will expire in 2028.

On the same day, Mr. Pham Van Trinh, Chief of Office of Binh Phuoc Provincial People's Committee, said that the Provincial People's Committee had received a petition from Son Hai Group regarding the bidding package of the Ho Chi Minh City - Thu Dau Mot - Chon Thanh Expressway project (section passing through the province). Binh Phuoc Provincial People's Committee has directed relevant departments to inspect and advise the province to respond to Son Hai Group according to regulations.

According to the report of the Binh Phuoc Province Construction Investment Project Management Board, the construction package for the Ho Chi Minh City - Thu Dau Mot - Chon Thanh Expressway, the section passing through Binh Phuoc Province, was consulted by Van Phu Consulting Joint Stock Company (located in Hanoi ) to prepare bidding documents and evaluate bidding documents.

On May 6, the expert team (established by the consulting unit) prepared a report evaluating the electronic bidding documents (E-HSDT) and sent it to the Binh Phuoc Provincial Construction Investment Project Management Board and opened the bid publicly online. There were 5 construction enterprises participating in the bidding, including Son Hai Group.

The evaluation results show that the E-HSDT of the 5 contractors are all valid, qualified and experienced. The winning bidder is the HCM-TDM-CT Expressway Joint Venture (including Truong Son Construction Corporation, NTV Thanh Phat Trading, Service and Construction Company Limited). The other 4 enterprises and Son Hai Group were "disqualified" due to unsatisfactory technical evaluation results.

Too frustrated, the leaders of Son Hai Group sent a petition to the People's Committee of Binh Phuoc province, stating that the unit is a capable and experienced contractor that has won bids and constructed highway projects and key national projects. When participating in the bidding package for this highway project, the group fully met the technical requirements of E-HSMT and committed to a 10-year warranty (5 years more than the E-HSMT regulations), saving maintenance and repair costs for the state during the operation process.

Notably, Son Hai Group said that the group invited the lowest bid price, which could save the state budget nearly 150 billion VND, but the investor chose the winning bidder as the HCM-TDM-CT Expressway Joint Venture.

"The investor not only eliminated us but also eliminated the three contractors ranked after us, all of whom are famous enterprises in the transportation sector of Vietnam," said the leader of Son Hai Group.

Son Hai Group found that the selection of contractors was not in accordance with E-HSMT and the provisions of the law on bidding, affecting the interests and reputation of the enterprise and causing loss to the state budget.

In addition, Son Hai Group said that through checking the members of the expert team on the system page "chungchidauthau.mof.gov.vn", Mr. Vu Ngoc Tru, Head of the expert team, had a bidding practice certificate that expired on October 18, 2023, so he did not meet the provisions of the Bidding Law.

Therefore, Son Hai Group requests the People's Committee of Binh Phuoc province to check and review the capacity of the members of the E-HSDT Evaluation Expert Team, establish an interdisciplinary expert team, independent of the investor and the bidding party to re-evaluate the E-HSDT, ensuring that the bidding goal is competition, fairness, transparency and economic efficiency, establish an independent interdisciplinary expert team, and re-evaluate the bid to ensure transparency.
