At the 10th session of the 15th National Assembly, National Assembly deputies of Group 8 (including deputies of the National Assembly Delegation of Bac Ninh province and the National Assembly Delegation of Ca Mau province) discussed and gave comments on the Draft Law amending and supplementing a number of articles of the Law on Intellectual Property.

Delegate Nguyen Nhu So (Bac Ninh) said that the Intellectual Property Law is the "fundamental law" of the knowledge-based economy , but many current regulations are outdated compared to the reality of digital transformation and international integration. Specifically, the delegate proposed to shorten the appraisal time, simplify procedures, and at the same time form a transparent intellectual property trading market, helping businesses access and exploit it more effectively.

Sharing the same view, delegate Leo Thi Lich (Bac Ninh) proposed that the draft Law amending and supplementing a number of articles of the Law on Intellectual Property be further reviewed to synchronize the Law with related laws, especially the Law on Science and Technology and the Law on Enterprises, to ensure consistency and feasibility during implementation.
Drawing on a real-life story, delegate Nguyen Duy Thanh (Ca Mau) said that most small and medium-sized enterprises in Vietnam do not consider intellectual property as a real business asset due to lack of capital and knowledge about exploiting and protecting intellectual property rights. Therefore, the delegate proposed to add separate regulations on intellectual property in innovation and business development activities.
At the same time, delegates proposed establishing a credit guarantee fund for intellectual property, allowing businesses to use patents and trademarks as collateral; in addition, forming a national intellectual property valuation center to support businesses in transparent technology valuation and transfer.
The delegate also emphasized the need to incorporate knowledge about intellectual property into general education and university programs, especially in the fields of technology and economics, to raise public awareness. Citing the case of "Phu Quoc fish sauce" being registered as a trademark abroad, the delegate warned that lack of understanding about intellectual property could cause Vietnamese products to lose their brand in the international market, thereby proposing that the law should have policies to support capital and guide registration for protection for people and small businesses.

Regarding copyright issues, many delegates expressed concerns about the widespread copyright infringement on digital platforms and artificial intelligence (AI), which seriously affects the rights of artists. Therefore, it is recommended to add specific regulations on works created by AI, increase sanctions for violations, and establish a mechanism to monitor and remove infringing content on the internet. In addition, it is necessary to set principles to protect creative people, ensuring that AI is not recognized as a human being, thereby maintaining human values in creative activities.
Regarding the commercialization of intellectual property, delegate Dinh Ngoc Minh (Ca Mau) proposed allowing the use of intellectual property rights as collateral for loans, and at the same time building a unified and transparent system for valuation, registration and trading of intellectual property, in order to unify capital flows for innovation and business development activities.

Sharing the view of increasing enforcement efficiency, delegate Tran Thi Van (Bac Ninh) also emphasized the need to improve the capacity to protect intellectual property rights, especially in e-commerce and import-export activities, through close coordination between state management agencies, economic police and customs forces to promptly detect and handle violations.
Most delegates agreed that this amendment to the Intellectual Property Law is an urgent requirement to protect creativity, promote innovation and develop the knowledge economy, and respond to the challenges of technology and artificial intelligence in the digital age.
