Ministry of Home Affairs proposes new subsidy policy for non-professional commune-level cadres

The Ministry of Home Affairs proposes that part-time workers at the commune level who quit their jobs before reaching the prescribed retirement age will enjoy three regimes.

The Ministry of Justice is reviewing the Draft Decree on staff streamlining, drafted by the Ministry of Home Affairs. When issued, this draft decree will replace Decree No. 29/2023/ND-CP dated June 3, 2023 of the Government on staff streamlining.

4 groups enjoy the policy of streamlining payroll

The draft lists four subjects that will implement the policy of streamlining the payroll. The first is cadres, civil servants, and public employees; commune-level cadres, civil servants, and people working under labor contracts will be subject to the same policies and regimes as civil servants according to Government regulations.

Second, people working under indefinite-term labor contracts performing professional and technical jobs in the list of job positions, specialized and common professional titles in public service units according to Government regulations, are redundant due to organizational restructuring or human resource restructuring of the unit according to the decision of the competent authority.

Third, part-time workers at the commune level will retire immediately after the implementation of the two-level local government model according to the provisions of the Law on Organization of Local Government, which is about to be considered and approved by the National Assembly.

The last group is the group of non-professional workers in villages and residential groups who are redundant due to village and residential group arrangements and will retire immediately after the arrangement decision of the competent authority.

Part-time commune-level cadres enjoy 3 regimes

Regarding the policy for non-professional workers at the commune level who have retired since the implementation of the two-level local government model, the draft decree also provides policies that are superior to current regulations.

According to the Ministry of Home Affairs, the policy applied to this group is designed based on the working process, similar to the design of the resignation policy for commune-level cadres and civil servants according to Decree No. 178/2024/ND-CP. Specifically, part-time workers at the commune level who have not reached the prescribed retirement age are entitled to 3 regimes.

Firstly, the group with less than 5 years of work and compulsory social insurance contributions will receive a one-time allowance equal to 0.8 times the current monthly allowance multiplied by the number of months of work with compulsory social insurance contributions.

This group is also entitled to a subsidy equal to 1.5 times the current monthly allowance for each year of work with compulsory social insurance; a subsidy of 3 months of the current monthly allowance to find a job and reserve the period of compulsory social insurance payment or receive a one-time social insurance payment according to the provisions of the law on social insurance.

Second, people who have worked for at least 5 years with compulsory social insurance and have 5 years or less until retirement age are entitled to a one-time allowance equal to 0.8 times the current monthly allowance multiplied by the number of months of early retirement compared to retirement age.

This group continues to receive a subsidy equal to 1.5 times the current monthly allowance for each year of work with compulsory social insurance; receives a subsidy of 3 months of the current monthly allowance to find a job and also reserves the period of compulsory social insurance payment or receives a one-time social insurance payment according to the provisions of the law on social insurance.

Third, people who have worked for at least 5 years with compulsory social insurance and have at least 5 years left until retirement age are entitled to a one-time allowance equal to 0.8 times the current monthly allowance multiplied by 60 months.

This group is also entitled to a subsidy equal to 1.5 times the current monthly allowance for each year of work with compulsory social insurance; a subsidy of 3 months of the current monthly allowance to find a job; and a reserve of the compulsory social insurance payment period or a one-time social insurance payment according to the provisions of the law on social insurance.

For commune-level cadres and civil servants due to the reorganization of commune-level administrative units in the 2023-2025 period, if they are assigned to work as part-time commune-level workers, the draft regulation stipulates that they will enjoy the same benefits as prescribed above, but the current monthly salary used to calculate the allowance is the salary of the previous month of the position of commune-level cadres and civil servants before being assigned to work as part-time workers at the commune level.

Part-time workers at the commune level who have reached retirement age according to regulations or are receiving pension or disability benefits are entitled to a one-time allowance equal to 15 months of the current monthly allowance.
