With the requirement to closely follow the guidelines and directions of the Central Executive Committee, the Politburo, the Central Steering Committee and the Government and the Prime Minister on streamlining the apparatus associated with restructuring the contingent of civil servants and public employees; ensuring that the arrangement does not affect the implementation of political tasks according to the functions and tasks of agencies, organizations and units; improving the efficiency and effectiveness of the operations of new agencies, organizations and units, especially tasks related to serving people and businesses. Accordingly, doing a good job of propaganda, political and ideological work, creating consensus and unity among the contingent of civil servants and public employees when carrying out the arrangement; Promote the exemplary responsibility of cadres and party members, especially party members holding leadership and management positions, in implementing the Party and State's policies on restructuring and streamlining the apparatus; pay attention to and promptly resolve the regimes and policies for civil servants and public employees after restructuring according to regulations. When developing the restructuring and streamlining project, ministries, agencies and localities must urgently develop a plan for restructuring and assigning civil servants and public employees, especially for leaders, managers and heads of agencies, organizations and units; develop a specific roadmap to implement the adjustment of the number of civil servants and public employees to ensure compliance with general regulations and in accordance with the functions and tasks of the newly formed agencies, organizations and units after restructuring. Promote the proactiveness and creativity of ministries, branches and localities in resolving the regimes and policies for civil servants and public employees according to the Government's regulations; Encourage ministries, branches and localities to base on conditions and capabilities to supplement policies other than those of the Central Government) to support redundant civil servants and public employees after restructuring the apparatus. Cadres and civil servants must strictly comply with the assignment of the organization and the decision of the competent authority. Heads of Party committees, agencies, organizations and localities must be responsible for arranging and deploying cadres and civil servants under their management, ensuring the set goals according to the requirements of the Central Committee. The arrangement and deployment of cadres must be carried out seriously, cautiously, scientifically and strictly; ensuring democracy, publicity, transparency, principles and specific criteria, in accordance with the practical situation of the cadres and civil servants and the requirements of each ministry, branch and locality; in which attention should be paid to arranging and using cadres with outstanding capacity, responsibility, dedication to work, meeting the requirements of tasks in the new situation. Linking the arrangement and assignment of personnel with streamlining the payroll and restructuring the staff of each agency, organization and unit; reviewing and evaluating the quality of the staff of the staff based on the requirements of the job positions at the new agency, organization and unit to carry out the arrangement and assignment of personnel, streamlining the payroll and restructuring the staff. The selection, arrangement and assignment of leaders and managers must be based on their capacity, strengths, prestige, work experience, and specific work products in accordance with the functions and tasks of the new organization, especially for the head. At the same time, it is necessary to ensure the standards of the positions according to the regulations of the Party and the law, linked to the structure and planning of the Party Committee to prepare well for the personnel work of the Party Congresses at all levels towards the 14th National Congress of the Party. Pay attention to, fully and promptly implement the regimes and policies for civil servants and public employees according to the Government's regulations and the regulations of ministries, branches and localities, ensure that after 5 years, the arrangement of redundant civil servants and public employees must be completed and the management and use of payroll must be implemented according to the general requirements of the Politburo at the newly established agencies, organizations and units after the arrangement from the date the competent authority approves the Project. The arrangement orientation for positions under the management of the Politburo and the Secretariat shall be considered and decided by the Politburo and the Secretariat according to their authority. For positions managed by Party committees, Party organizations, leaders, agencies, units, and localities according to the decentralization of ministries, ministerial-level agencies, agencies under the Government, People's Committees of provinces and centrally-run cities, and merged and consolidated agencies, organizations, and units, proactively develop plans for the arrangement and assignment of cadres to ensure the principles in personnel work and the purposes, requirements, and principles in the arrangement and assignment of civil servants and public employees mentioned above in the same direction as for heads of agencies, organizations, and units, based on practical conditions and standards, cadre capacity, the collective leadership of ministries, branches, and localities decides to select heads who meet the requirements and tasks of the new agencies, organizations, and units after the arrangement; the selected personnel may be inside or outside the agencies, organizations, and units that are merged or consolidated into that new unit. In case the head of the agency, organization or unit implementing the arrangement does not continue to be the head, he/she will be arranged and assigned to the next lower position and enjoy the policy according to the Government's regulations on the arrangement of the organizational apparatus. Regarding the deputy of the head, based on the actual number of deputies of the head of the agency, organization or unit implementing the merger or consolidation, the collective leadership of the Ministry, branch or locality shall decide to arrange him/her as the deputy of the head of the new agency, organization or unit after the arrangement or arrange him/her to another agency, organization or unit according to the requirements of the tasks and capacity of the staff. In the immediate future, the number of deputies of the head of the agency, organization or unit formed after the arrangement may be higher than the regulations, but the ministry, branch or locality must develop a plan to reduce the number of deputies according to the general regulations within 05 years from the date the competent authority approves the Project. For civil servants who do not hold leadership or management positions in ministries, branches and localities, based on the functions, tasks and organizational structure formed after the reorganization, propose a plan for the reorganization and assignment of civil servants in accordance with the tasks they were undertaking before the merger or consolidation; in case they no longer have tasks, they can be assigned to other agencies, organizations or units that are suitable for the expertise and profession of civil servants or resolve policies according to the Government's regulations. In the immediate future, the maximum number of staff of the new agencies, organizations or units must not exceed the total number of civil servants currently present before the merger or consolidation, but ministries, branches and localities must develop a plan to reduce staff, implemented in accordance with the general regulations of the Politburo within 05 years from the date the competent authority approves the Project. After implementing the organizational restructuring, ministries, branches and localities have plans to train, foster and improve the professional qualifications of staff to meet the requirements of the political tasks of agencies, organizations and units in the new situation; review and reduce staffing in cases that do not meet task requirements and lack a sense of responsibility.
