Adding many humane provisions in a number of draft laws drafted by the Ministry of Public Security

At the October press conference on human rights and foreign affairs information held on the morning of October 23, Major General Tran Nguyen Quan, Deputy Director of the Department of Legislation and Administrative Reform of the Ministry of Public Security, informed reporters about a number of draft laws drafted by the Ministry of Public Security to be submitted to the 15th National Assembly at the 10th session.

According to the program of the 10th Session of the 15th National Assembly, the Ministry of Public Security will preside over the drafting of 10 draft laws, including: Law on Extradition; Law on Transfer of Persons Serving Prison Sentences; Law on Enforcement of Criminal Judgments (amended); Law on Enforcement of Temporary Detention and Prohibition from Leaving Place of Residence; Law on Drug Prevention and Control (amended); Law on Amending and Supplementing a Number of Articles of the Law on Judicial Records; Law on Cyber ​​Security; Law on Protection of State Secrets (amended); Law on Amending and Supplementing a Number of Articles of 10 Laws Related to Security and Order; and Law on Amending and Supplementing a Number of Articles of the Law on National Defense and Security Industry and Industrial Mobilization.

Add more humane regulations in criminal enforcement

According to Major General Tran Nguyen Quan, the draft Law on Enforcement of Criminal Judgments (amended) has added many new points, such as the regulation that commune-level police are assigned a number of tasks to execute criminal sentences; the regulation that prisoners have the right to donate tissue, part of their body parts, and to store eggs and sperm according to the law; the right to enjoy the regime and policies according to the law on donation of human tissue and body parts; the regulation that prisons organize labor for prisoners inside and outside the prison to educate, reform, and practice labor skills, contributing to preparing for reintegration into the community.

Meanwhile, the draft Law on Detention, Temporary Detention and Prohibition of Leaving the Place of Residence also adds a separate chapter on the implementation of the measure of prohibiting leaving the place of residence to ensure the effective implementation of this measure in practice. In addition, the draft law adds a number of regulations on the regime of detainees, temporary detainees, temporary detainees, temporary detainees who are under 18 years old, pregnant women or women raising children under 36 months old, and death-sentenced persons who are in temporary detention, such as: Receiving money and essential items for daily life sent by relatives and regulations on the organization of canteens by detention facilities; sending and receiving letters, books, newspapers and documents; medical care regime; spiritual living regime...

Regarding the draft Law on Extradition, the Ministry of Public Security has added provisions on notification related to the death penalty for the person requested for extradition to ensure compliance with the practice of handling extradition requests, preventing criminals from evading legal punishment with the ultimate goal of capturing fugitives. At the same time, the draft Law on Transfer of Persons Serving Prison Sentences stipulates more clearly the principles, authority, conditions, order and procedures for transfer between Vietnam and foreign countries, ensuring respect for the independence, sovereignty and legitimate rights of the transferred person.

Notably, according to Major General Tran Nguyen Quan, the draft Law amending and supplementing a number of articles of the Law on Judicial Records has added provisions on electronic Judicial Records, diversified methods of issuing Judicial Records, reduced the time for issuing Judicial Records to 5 days; added provisions on not distinguishing administrative boundaries in requests for issuance of Judicial Records, accordingly, individuals have the right to submit applications for issuance of Judicial Records directly to any provincial-level or commune-level Police.

Responding to the requirements of protecting national sovereignty in cyberspace

Sharing at the conference, Major General Tran Nguyen Quan affirmed that data is considered the "core" of the digital transformation process. In the era of the 4th Industrial Revolution, data is a national asset. In the draft Law on Cyber ​​Security, the Ministry of Public Security has added regulations on ensuring data security. affirmed that ensuring data security is an extremely important, indispensable factor and a consistent requirement in the process of national digital transformation and building a digital ecosystem in Vietnam now and in the future.

The draft law also adds a provision requiring businesses providing services in cyberspace to be responsible for identifying IP addresses and providing them to specialized forces for protecting cyber security, in order to overcome shortcomings in tracing, fighting and preventing high-tech crimes, and meeting the requirements of protecting national sovereignty in cyberspace.

Regarding the draft Law on Protection of State Secrets (amended), the Ministry of Public Security proposed to expand the permission to draft and store state secrets on computer networks called "independent LANs" established within the headquarters of agencies and organizations. Add regulations prohibiting the use of artificial intelligence systems to violate state secrets to ensure compliance with the development of science and technology, including the development of artificial intelligence systems in the current period.

The remaining draft laws focus on adjusting and perfecting the institutions of state management, security and order, and security industry. In particular, the draft Law amending and supplementing a number of articles of 10 laws related to security and order regulates a series of regulations on residence, immigration, identification, traffic, fire prevention and fighting, etc., in order to reduce and simplify administrative procedures, ensuring unified management in the context of two-level local government.
