Supplementing land price determination cases to ensure consistency in implementation

Discussing at Group 14 (including the National Assembly delegations of Quang Ninh, An Giang, and Ha Tinh provinces) on the morning of November 19, National Assembly deputies proposed adding cases of land price determination to ensure consistency in implementation, avoiding overlap or conflict when applying regulations on land price determination at the transitional time.

Shorten the time for compensation and resettlement support

The majority of the National Assembly Deputies of Group 14 agreed to issue a Resolution of the National Assembly stipulating a number of mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law. At the same time, they proposed to continue reviewing and perfecting the draft Resolution to be consistent with the specific policies and viewpoints of competent authorities; ensuring its constitutionality, legality, and consistency with the legal system; ensuring feasibility, fairness, transparency, and not causing complaints or lawsuits, affecting the rights of the people.

National Assembly Deputy Tran Dinh Gia ( Ha Tinh ) said that the draft Resolution will contribute to solving difficulties and problems in organizing the implementation of the Land Law such as: supplementing cases where the State reclaims land; regulating the application of land price tables and land price adjustment coefficients to calculate financial obligations and compensation when the State reclaims land instead of determining specific land prices, thereby shortening the time for price determination; shortening the time for compensation, resettlement support and land reclaimation...

According to National Assembly Delegate Do Thi Lan (Quang Ninh), if this is not included in the Resolution to resolve the issue, the progress of urgent and important national projects, including investment projects for natural disaster prevention and control, storms and floods, etc., will be delayed for a period of time.

Commenting on the regulations on land allocation, land lease, and land use conversion (Article 4) of the draft Resolution, delegate Tran Dinh Gia proposed to consider removing Clause 5, because in the case of residential land auctions, if only based on zoning or general planning, the residential land area in the plot cannot be determined, leading to the inability to calculate the land price. Meanwhile, according to the draft Resolution, the land price table and adjustment coefficient will be applied to determine the land price.

Clause 7 stipulates: “Allowing adjustment of land use term for new investors to replace dissolved or bankrupt investors; investors receiving transfer of investment projects using land. New investors and investors receiving transfer of investment projects must pay additional land use fees and land rents according to the provisions of law”.

With the above regulation, delegate Tran Dinh Gia proposed that the Government provide detailed regulations to ensure there is sufficient basis for adjusting land use duration, clearly defining the time of permission for adjustment and the form of adjustment, avoiding difficulties and problems arising in the process of practical application.

Regarding land prices, National Assembly Deputy Tran Thi Kim Nhung (Quang Ninh) commented that the land price policy has changed its perspective greatly. Previously, according to Resolution No. 18-NQ/TW dated June 16, 2022 on "Continuing to innovate and perfect institutions and policies, improving the effectiveness and efficiency of land management and use, creating momentum to turn our country into a high-income developed country", land prices were based on market prices.

However, the change in perspective is correct in determining land prices according to the market, especially when the land database and transfer information are incomplete and difficult to determine. Currently, the policy has almost returned to building land price tables as before.

Commenting specifically on the land price list in Article 7, delegate Tran Dinh Gia suggested removing Clause 6, and at the same time, Clause 4 should add the case of determining land prices stipulated in Clause 2, Article 257 of the 2024 Land Law, amending it to: "For the case of applying specific land prices stipulated in Article 160, Clause 2, Article 257 of the 2024 Land Law, but by the effective date of this Resolution, the competent authority has not yet issued a decision on specific land prices, the People's Committee at the provincial level shall decide on determining land prices according to the provisions of this Resolution or continue to determine specific land prices according to the provisions of the Land Law...".

According to delegate Tran Dinh Gia, the above amendment aims to ensure consistency in the implementation process, avoiding overlap or contradiction when applying regulations on land price determination at the transitional time.

Sharing this view, delegate Do Thi Lan suggested that further consideration should be given to the content related to the decision on land compensation prices in emergency cases.
