The Draft Law on Civil Aviation of Vietnam has just been completed by the Civil Aviation Authority of Vietnam, aiming to replace the current Law after 19 years of implementation, with many strong innovations suitable for the development of the aviation industry, technology application and international integration trends.
Ensuring aviation safety according to international standards
According to the Civil Aviation Authority of Vietnam, this draft Law on Civil Aviation focuses on perfecting the legal framework for specialized state management. One of the highlights is to enhance the capacity of aviation safety supervision and inspection for management agencies; at the same time, supplement the roles and functions of the Aviation Authority and Airport Authority.
In addition, the Draft also builds a mechanism to support the development of the domestic aviation industry, including preferential policies, investment in research, technology application and training of high-quality human resources, contributing to building a modern and sustainable aviation industry.
Regarding aviation safety, the Draft Law fully updates the requirements of the International Civil Aviation Organization (ICAO), especially in establishing a national safety management system and ensuring independence between the accident investigation agency and the state aviation management agency.
In particular, the new Law emphasizes effective coordination between civil and military aviation in flight operations and management of aviation obstacle surfaces. The mechanism of decentralization and increased responsibility of localities in controlling building heights and planning airport areas is also included in the draft.
Expanding mechanisms to attract non-state investment
The draft Law on Civil Aviation expands the mechanism for attracting non-state investment in the aviation sector, while reducing the budget burden, promoting administrative reform, improving the business environment, and strengthening the fight against corruption and waste in management.
Along with that, the Draft encourages breakthroughs in science and technology, digital transformation and innovation associated with sustainable development, environmental protection and climate change response.
This draft Law also aims to overcome a series of shortcomings from the current Law such as: Lack of consistency in airport planning, incompatibility with provisions on aircraft export, signing aviation human resources contracts that are not in accordance with the Labor Code, unclear regulations on airport enterprises and airport operators, airports, etc.
The Government is expected to submit to the National Assembly the Draft Law on Civil Aviation of Vietnam (replacement) at the October 2025 session for consideration and approval.
