Are there any legal "loopholes" or "gaps" in milk management?

On the afternoon of April 16, continuing the 44th session, the National Assembly Standing Committee reviewed the report summarizing the results of supervising legal documents in the areas under the responsibility of the Ethnic Council and the National Assembly Committees in 2024.

Speaking at the meeting, Chairman of the National Assembly Delegation Work Committee Nguyen Thanh Hai said that the report did not mention any overlapping documents, especially any "loopholes" or "gaps" that could be immediately recommended.

“Recently, the incident involving 600 types of fake milk being sold openly on the market for the past 4 years has raised many questions about “loopholes” in management and legal documents,” Ms. Nguyen Thanh Hai also raised the issue that post-inspection is currently not being fully and strictly implemented.

The Chairwoman of the National Assembly Delegation Work Committee said that voters discussed that there is a legal “gap” in the management of the milk market and milk advertising. “If celebrities participate in advertising, how much responsibility do they have… consumers cannot verify it, and using it will affect their health. So, are there any “gaps” in the legal documents?”, said Ms. Nguyen Thanh Hai.

Ms. Nguyen Thanh Hai suggested that the report should analyze and supplement legal "loopholes", from which to recommend that agencies supplement them, thereby providing information to both voters and people nationwide.

Regarding this issue, Vice Chairman of the National Assembly Tran Quang Phuong said that milk management is an area that affects consumers and is under the authority of the National Assembly's Committee on Culture and Society to supervise legal documents.

The Vice Chairman of the National Assembly requested that the Chairman of the National Assembly's Committee on Culture and Society should report on this issue to the National Assembly's Committee on Petitions and Supervision in accordance with his functions and duties.

Reporting at the meeting, Chairman of the National Assembly's Committee for People's Aspirations and Supervision Duong Thanh Binh said that, in terms of implementing the supervision recommendations in the reports on the results of supervising legal documents in 2023, basically, the Government, ministries and branches have made many efforts in implementing the recommendations of the National Assembly agencies at the 2023 supervision session; and have issued 52 additional detailed regulations that were "in arrears" from before.

However, there are still 35 detailed regulations for the implementation of 14 laws and 2 ordinances that have not been issued, including contents that have been "in arrears" for more than 10 years and have been repeatedly recommended; there are 4 documents with inappropriate regulations, not ensuring the strictness and consistency of the legal system that have not been amended or supplemented.

Regarding the results of monitoring legal documents in 2024, regarding the timeliness and completeness of document issuance, there are 79 documents issued later than the effective date of laws, ordinances and resolutions; there are 147 articles and clauses of 21 laws with detailed regulations that have not been issued.

Regarding the constitutionality, legality, and consistency of documents in the legal system, the promulgated legal documents basically ensure compliance with the provisions of the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the National Assembly Standing Committee. However, through supervision, the National Assembly agencies have pointed out 3 documents that do not ensure the consistency and synchronization of the legal system, 3 documents, 22 contents are not suitable, have not been specifically regulated, have difficulties and problems in implementation...

The Chairman of the National Assembly's Committee for People's Aspirations and Supervision said that in 2025, along with reviewing and amending the 2013 Constitution, the National Assembly will review and promulgate many important laws on the organization and operation of the state apparatus, on judicial proceedings, etc. With the spirit of innovation in legislative thinking, the law only regulates framework issues and issues of principle, and assigns the Government, ministries and branches to specify many contents for implementation.

In that context, with the increasing demand for the quantity and quality of documents, the National Assembly's Committee for Petitions and Supervision recommends that the Government, ministries and branches seriously implement and closely follow the Law and Ordinance Development Program of the National Assembly and the National Assembly Standing Committee in 2025, proactively study the contents that need detailed regulations right from the research and drafting process to meet the requirements of the Law on Promulgation of Legal Documents. At the same time, regularly direct, inspect, urge and effectively regulate the coordination between agencies in the process of developing detailed regulations to ensure progress and quality.
