Deputy Minister of Health Do Xuan Tuyen has just signed and issued a Circular regulating the decentralization and division of authority of two-level local authorities in the field of traditional medicine and pharmacy.
Accordingly, in this Circular, the Ministry of Health clearly states the authority to issue and re-issue traditional medicine practitioner certificates to the subjects specified in Clause 2 and Clause 3, Article 1 of Circular No. 02/2024/TT-BYT dated March 12, 2024 of the Minister of Health regulating the issuance of traditional medicine practitioner certificates, certificates of people with traditional medicine prescriptions, certificates of people with traditional treatment methods, combining traditional medicine with modern medicine at medical examination and treatment facilities (referred to as Circular No. 02/2024/TT-BYT) by specialized health agencies under the People's Committees of the provincial level.
The dossier, order and procedures for granting and re-granting traditional medicine practitioner certificates shall comply with the provisions in the Appendix issued with this Circular.
The authority to revoke the medical practitioner certificate granted to the subjects specified in Clause 2 and Clause 3, Article 1 of Circular No. 02/2024/TT-BYT is implemented by the specialized medical agency under the People's Committee of the province.
The procedure for revoking the medical practitioner certificate granted to the subjects specified in Clause 2 and Clause 3, Article 1 of Circular No. 02/2024/TT-BYT shall be carried out according to the procedure specified in Article 19 of Circular No. 02/2024/TT-BYT.
The Circular of the Ministry of Health also clearly states that the authority to receive reports on arising issues affecting project implementation and recommendations and proposed solutions is stipulated in Point e, Clause 3, Article 14 of Circular No. 10/2022/TT-BYT dated September 22, 2022 of the Minister of Health guiding the implementation of investment contents and support for the development of precious medicinal herb growing areas under the National Target Program on socio-economic development of ethnic minority and mountainous areas for the period 2021 - 2030, phase I: from 2021 to 2025 (hereinafter referred to as Circular No. 10/2022/TT-BYT) implemented by the Provincial People's Committee.
Regarding the transitional provisions, the Ministry of Health clearly states that for dossiers submitted before the effective date of this Circular: The dossier receiving agency shall continue to process them according to current regulations until the end of the administrative procedure.
Localities implementing the project continue to implement investment contents and support the development of precious medicinal herb growing areas approved by competent authorities according to the provisions of Circular No. 10/2022/TT-BYT until completion.
According to the Ministry of Health, this Circular takes effect from July 1, 2025 and expires from March 1, 2027.
Replace the word "district" with the word "province" in Clause 1, Article 6 and replace the word "district" with the word "commune" in Clause 2, Article 6 of Circular No. 10/2022/TT-BYT.
During the effective period of this Circular, if the provisions on authority and responsibility for state management in this Circular are different from the Circulars issued by the Minister of Health before July 1, 2025, the provisions in this Circular shall apply.
According to the Ministry of Health, during the implementation process, if there are any difficulties or problems, agencies, organizations and individuals should report to the Ministry of Health (Department of Traditional Medicine and Pharmacy Management) for consideration and resolution./.
