Commune police are allowed to patrol and control the commune and village roads under their management. Violations that are handled include: Not wearing helmets; carrying more people than the prescribed number; carrying bulky goods; stopping and parking vehicles in violation of regulations.
The Ministry of Public Security has just issued Circular 73/2024, effective from January 1, 2025, regulating the patrol, control, and handling of violations of laws on road traffic order and safety (TTATGT) by traffic police.
Notably, the above circular sets out a number of contents regulating the tasks of other forces in the people's police, including the commune-level police force.
Commune police will be able to handle some traffic violations from January 1, 2025.
Accordingly, in case there is no traffic police force to patrol and control road traffic safety according to plan, the commune-level police are allowed to carry out this task in accordance with the plan issued by the competent authority.
Circular 73/2024 clearly states that commune-level police are only allowed to patrol and control commune and village roads under their management. When detecting drivers of motorbikes, mopeds, and rudimentary vehicles committing certain illegal acts that, if not promptly stopped, will cause dangerous consequences to society, they will be handled according to the provisions of the law.
These behaviors include: Not wearing a helmet; carrying more people than the prescribed number; carrying bulky goods or goods exceeding the prescribed size limit; stopping or parking the vehicle in violation of regulations; weaving, swerving, driving on one wheel for two-wheeled vehicles; not having a rearview mirror on the left as prescribed.
Using an umbrella; pulling or pushing another vehicle or object; not being of legal age to operate a vehicle or discovering a vehicle that seriously violates road traffic order and safety, security, or social order.
When detecting a violation of the law, the commune police have the right to prevent it (illustrative photo).
During the process of resolving and handling the above violations, if other violations are discovered, the commune police will handle them according to their authority. If the sanctioning authority is exceeded, a record of the administrative violation will be drawn up and a report will be made to the competent authority to issue a decision on the administrative sanction.
Also according to Circular 73/2024, other forces in the people's police when performing the task of patrolling and controlling road traffic safety are equipped with: Horns, loudspeakers, traffic batons, vehicles, professional technical equipment, weapons, other support tools according to regulations and violation handling forms.
During the time of participating in coordinating the implementation of tasks, these forces will receive compensation and allowances according to the provisions of law for forces participating in the work of ensuring order and safety of road traffic.
