How are civil servants and public employees affected?

To limit the impact of the restructuring and streamlining of the apparatus on cadres, civil servants and public employees, the Government Steering Committee believes that there needs to be a strong enough policy that is prominent to the affected subjects.

Assessing the preliminary impact of the plan to reorganize and streamline the Government's apparatus, the Steering Committee on summarizing the implementation of Resolution No. 18-NQ/TW (Government Steering Committee) said that according to the direction of the Central Steering Committee, on the basis of implementing the above plan, the apparatus of the 15th and 16th Governments (term 2026-2031) will be streamlined to 13 ministries and 4 ministerial-level agencies (reducing 5 ministries). There are 4 agencies under the Government (reducing 4 agencies under the Government).

Internal organization continues to streamline and streamline focal points, drastically reduce general departments, bureaus, divisions, and public service units under ministries, bureaus, divisions, and public service units under general departments.

Overlap and interference correction

After streamlining the focal points and adjusting the functions and state management tasks of ministries and ministerial-level agencies, the current overlapping problems have basically been overcome.

The Government Steering Committee's plan is to maintain 8 ministries and ministerial-level agencies (with rearrangement and streamlining of internal organization), including: Ministry of National Defense; Ministry of Public Security; Ministry of Justice; Ministry of Industry and Trade; Ministry of Culture, Sports and Tourism; Government Office ; Government Inspectorate; State Bank of Vietnam.

Restructure, arrange and merge the remaining 14 ministries and ministerial-level agencies, including merging the Ministry of Planning and Investment and the Ministry of Finance; the Ministry of Transport and the Ministry of Construction; the Ministry of Natural Resources and Environment and the Ministry of Agriculture and Rural Development; the Ministry of Information and Communications and the Ministry of Science and Technology; the Ministry of Labor, War Invalids and Social Affairs and the Ministry of Home Affairs. The Ministries of Education and Training, Health, Foreign Affairs and the Ethnic Committee will receive additional functions, tasks and organizations.

According to the Government Steering Committee, this plan has the advantage of perfecting the multi-sectoral, multi-field management model for a number of fields according to the requirements of Resolution No. 18, 19-NQ/TW, Resolution No. 56/2017/QH14, Conclusion No. 74-KL/TW, Conclusion No. 50, 62-KL/TW, and the direction of General Secretary To Lam; at the same time, it reasonably adjusts the assignment of state management for a number of sectors and fields, overcoming overlaps and interferences in functions and tasks between ministries and ministerial-level agencies.

Along with the above-mentioned arrangement of the Government apparatus organization model, the internal organization of ministries, ministerial-level agencies, and Government agencies will be rearranged to be streamlined, effective, and efficient; at the same time, restructuring the staff, civil servants, and public employees, improving the quality of the staff and thoroughly streamlining the payroll, in conjunction with implementing the policy of attracting talented people to the public sector in accordance with the direction of the Politburo and the Party Central Committee.

However, this option has limitations due to the large number of agencies subject to restructuring and the wide scope of impact, which inevitably affects the thinking of cadres, civil servants, and public employees, especially those holding leadership positions.

Implementing this arrangement plan, the scale and scope of a number of multi-sectoral and multi-field management ministries will be large, placing high demands on the heads of ministries and their leadership teams. Therefore, careful preparation in personnel work is needed to ensure the plan is implemented synchronously and effectively.

Have strong and outstanding policies for affected subjects

The arrangement of the Government apparatus organization related to adjusting the names, functions and tasks of a number of ministries and ministerial-level agencies is currently regulated in specialized laws.

Through reviewing 247 laws, there are 113 laws regulating the names, functions, and tasks of ministries, ministerial-level agencies, and government agencies subject to the above-mentioned arrangement.

When the National Assembly issues a Resolution on the organizational structure of the Government, there will be a transitional provision as follows: the functions, tasks and powers of a number of ministries and ministerial-level agencies that have been prescribed in current laws and ordinances, but now have changes in structure and organization according to this Resolution, will be transferred to the corresponding ministries and ministerial-level agencies from the date these agencies are reorganized.

Assign the Government to decide on the division of authority of the Prime Minister, Ministers, and Heads of ministerial-level agencies or decentralize to local authorities the decision on issues in specialized laws that currently assign authority to the Prime Minister, Ministers, and Heads of ministerial-level agencies, ensuring compliance with the functions and tasks of the Government as prescribed by the Constitution.

To limit the impact of the restructuring and streamlining of the apparatus on cadres, civil servants and public employees, the Government Steering Committee believes that there should be strong and outstanding policies for those affected by the restructuring process to reduce the pressure on the ideology and psychology of cadres, civil servants and public employees and ensure the rights of cadres, civil servants and public employees during the restructuring and streamlining of the apparatus.

Report to the Central Steering Committee before December 31

Based on the Plan to summarize the implementation of Resolution No. 18-NQ/TW of the Central Steering Committee, the Ministry of Home Affairs has submitted to the Prime Minister for promulgation Decision No. 1403/QD-TTg dated November 16, 2024 to establish a Steering Committee on summarizing the implementation of Resolution No. 18-NQ/TW to direct the contents under the responsibility of the Government Party Committee that need to be implemented (as assigned by the Central Steering Committee), along with the Working Regulations of the Steering Committee and the Plan to summarize the implementation of Resolution No. 18-NQ/TW, ensuring consistency and agreement with the Plan of the Central Steering Committee.

According to the Central Steering Committee's Plan, ministries and branches are responsible for preparing a summary report and sending it to the Central Steering Committee before December 31, 2024.

To ensure the progress of the report preparation of the Government Party Committee, the Ministry of Home Affairs proposes to the Prime Minister to direct ministries and branches to complete the report and send it to the Ministry of Home Affairs and the Government Office before December 15, 2024. The Ministry of Home Affairs will proactively prepare the Report of the Government Party Committee based on the 5-year review report on the implementation of Resolution No. 18-NQ/TW and update the results of 7 years of implementation of Resolution No. 18-NQ/TW (as of September 30, 2024).

The representative of the Ministry of Home Affairs said that after receiving reports from ministries and branches, the Ministry will synthesize, review and complete the Report, submit it to the Government Party Committee on December 25, 2024, in time to send it to the Central Steering Committee on December 31, 2024.

During the process of developing and completing the Report, the Ministry of Home Affairs will coordinate with the Central Organizing Committee to organize conferences, seminars and surveys, and work with a number of agencies and organizations to unify the direction of summarizing Resolution No. 18-NQ/TW./.
