The amendments and additions to several articles of the 2013 Constitution focus on two important groups of content. Firstly, provisions related to the Vietnam Fatherland Front and socio- political organizations. Secondly, provisions in Chapter IX to implement a two-tiered model of local government organization; and transitional provisions to ensure the smooth and uninterrupted operation of local governments, in line with the roadmap for rearranging and merging provincial and commune-level administrative units, without establishing a district level.

Accordingly, the Ministry of Justice was tasked with gathering public and other agency opinions within one month, and compiling the feedback to submit to the Government for presentation to the Committee on drafting amendments and additions to certain articles of the 2013 Constitution.

According to the plan, the deadline for completing the amendment and supplementation of several articles of the 2013 Constitution is June 30th at the latest.

Speaking on the sidelines of the National Assembly, Representative Nguyen Chu Hoi (from the Hai Phong National Assembly delegation) said that, in the spirit of "running and queuing at the same time," the National Assembly is preparing, continuing discussions, and simultaneously gathering public opinion. PV:   Sir, we are currently in the process of gathering public feedback on the draft Resolution amending the 2013 Constitution. How do you assess this one-month-long feedback process? Do you expect this to be a substantial and effective contribution to the constitutional amendment?

Representative Nguyen Chu Hoi: We all know that this National Assembly session is historic, aimed at resolving issues of historical significance. This includes focusing on amending the Constitution and related laws to perfect new regulations and rules to ensure the smooth operation of the apparatus in accordance with the spirit of the Central Committee's resolutions – which are to institutionalize and further concretize and realize these resolutions so that the apparatus operates effectively and efficiently.

It must be said that from the central government to local authorities and even policy-making bodies like the National Assembly, everyone is under time pressure. Therefore, the approach is crucial.

First, I understand that we don't need to amend the entire Constitution, but only make technical revisions to about 8-9 articles. Currently, it's planned to be 8 articles.

This is not a process of amending the entire Constitution, so the time allocated for public consultation does not need to be as long as stipulated by law.

We are also in the spirit of "running and queuing at the same time," so the approach is to proceed in parallel. The National Assembly is preparing and continuing discussions, while simultaneously gathering public opinion. From May 6, 2025, we began collecting public opinion, and according to preliminary reports, the vast majority have expressed agreement.

PV: The constitutional amendment is seen as a way to ensure the sustainability and adaptability of the Constitution to societal changes and development requirements. Could you elaborate on the sustainability of the Constitution after this amendment?

Representative Nguyen Chu Hoi: We have a unified policy in place, and the work is underway. This is the final step, therefore, most opinions agree on the approach, the provisions, and the guiding principles for amendment; amendments are necessary and unavoidable.

However, several issues need to be noted. Firstly, it is necessary to avoid duplication within the amendments themselves and within the proposed amendments to the Constitution with the Law on the Organization of Local Government.

Secondly, in terms of revising the text's format, it must be done rigorously. Because the Constitution has a "very long lifespan," it addresses constitutional issues. However, the different terms of the National Assembly and the various periods of national development are defined as issues "derived from practical experience."

In legal matters, besides legal regulations, there are also legal practices. This is also true internationally, as in United Nations conventions, where the practical aspects of law are very important. Specifically, the International Convention on the Law of the Sea also highly respects legal practices in different maritime zones. This is precisely the experience in resolving practical issues.

The same applies to the Constitution. Accordingly, if we want the Constitution to have open but very strict provisions, its lifespan must be long, but in each period, it can flexibly use different terminology.

Therefore, the Law on the Organization of Local Government is intended to concretize and realize the issues stipulated in the Constitution. This ensures the flexibility of a constitutional document. It will facilitate its application in the future, not only during this period but also in other periods, with different rights. And amendments will also be easier when needed.

PV:   This constitutional amendment mentions socio-political organizations affiliated with the Vietnam Fatherland Front. As a delegate nominated by the Vietnam Fatherland Front, what contributions have you made regarding this matter?

Representative Nguyen Chu Hoi: According to the new regulations, the amended Constitution defines the role and position of the Vietnam Fatherland Front, as well as of other mass organizations established and managed by the State. I believe that the word "under the direct control" here should be understood as being under the management of the Vietnam Fatherland Front.

The Vietnam Fatherland Front is a unifying organization; a Fatherland Front without unifying forces is not a Fatherland Front. Whether outside or inside, under whose management, everyone is still "under the hat of the Fatherland Front." This time, the Constitution and the new system more specifically define the role of the Fatherland Front. Thus, it is still based on ensuring the independence of organizations to promote the unique characteristics, goals, and distinct nature of each sector. That is, there are still differences, but they are under common management. Just like personnel working in any field, at any level, or under any model, are still subject to state management in education and training.

In principle, every nation has unified state management. This unity is not about "confining everything to one cage," but rather about interconnectedness and coordination under the State. Therefore, I believe that future activities of the Vietnam Fatherland Front and the law on the Fatherland Front, if necessary, should be amended to align with this new spirit. This means unified management within the Fatherland Front bloc, while still allowing for independent operation to leverage the unique characteristics of each sector.
