The Ministry of Finance has just issued an official dispatch providing additional guidance on the handover, management, and handling of public assets, including infrastructure assets, assets with established public ownership, and assets of projects using state capital.
Accordingly, for infrastructure assets during the process of administrative unit arrangement and reorganization, the (new) commune-level administrative unit after arrangement is responsible for receiving, inheriting the management and use of infrastructure assets managed by the (old) commune level.
If the (old) commune level is divided into many (new) commune levels, each new unit will receive assets in its management area; in case the assets are located in many new commune areas, the Chairman of the Provincial People's Committee will decide to assign the provincial or (new) commune level agency to receive and manage.
For assets located in many new commune-level administrative units, the Chairman of the Provincial People's Committee shall decide on assigning the responsibility of receiving, inheriting the management and use to the provincial agency or the (new) commune-level administrative unit. |
For the district level, the assets of irrigation infrastructure and markets managed by the district level will be received and inherited by the (new) commune level if they are located within its administrative boundaries. In case the assets are spread over many new communes, the Chairman of the Provincial People's Committee will decide on the receiving unit.
For other types of assets, the District People's Committee will synthesize and report to the specialized agency under the Provincial People's Committee so that the Chairman of the Provincial People's Committee can decide to assign management to the provincial or commune-level agency (new).
At the provincial level, the (new) provincial administrative unit is responsible for receiving and inheriting the management of infrastructure assets managed by the (old) provincial level.
Regarding assets with established ownership rights of the entire people, the new commune, district and provincial administrative units must also receive, manage and handle assets currently managed by the old commune, district and provincial administrative units if the handling has not been completed upon arrangement.
The Ministry of Finance also further instructed that the temporary holding account at the State Treasury, the District Finance and Planning Department will transfer the temporary holding account to the Department of Finance and notify the agencies with revenue to make payment of expenses, while the Department of Finance is responsible for managing the amount according to regulations.
The asset handover process is carried out by agencies and units taking inventory, making a list of public assets and based on the administrative unit arrangement plan to hand over assets to the receiving unit. The handover must be recorded in detail, ensuring no interruption in service provision and avoiding loss and waste of assets.
For assets of projects using state capital, the project management board and the investor are responsible for completing the handover of assets to beneficiaries according to regulations. For unfinished projects, management continues to be carried out according to the transitional guidance on public investment management when reorganizing the local government apparatus.
Also according to the Ministry of Finance, the responsibility for receiving, managing and handling infrastructure assets and public assets when arranging administrative units at all levels is to ensure effective and transparent management and not interrupt the provision of public services.
