On the morning of November 6, discussing in the Group on the draft Law on Construction (amended), delegates proposed a number of solutions to perfect the legal framework in implementing the regulation on exemption from construction permits.
Delegates agreed with the draft to remove the design appraisal procedure implemented after the basic design, changing from "pre-inspection" to "post-inspection". Delegates said that this change gives the investor the initiative in appraising and controlling technical designs and construction drawing designs, reducing intermediaries. However, a design quality control mechanism is needed to avoid risks.
Mr. Ha Sy Dong - National Assembly Delegate of Quang Tri province expressed his opinion: "The concern is whether the quality of technical design is guaranteed when there is no longer any appraisal and the investor may not have the capacity to self-appraise, especially for large-scale projects. I suggest that the drafting committee consider adding a control mechanism when the investor appraises the design, specifically for large-scale projects with complex techniques, requiring the investor to hire a consulting organization with sufficient appraisal capacity."
In addition to strengthening post-inspection, delegates suggested that it is necessary to study the exemption of construction permits in areas with clear planning.
"We already have an information technology system to monitor construction order activities in real life, so we can strongly shift from pre-inspection to post-inspection and then perhaps we will only stipulate that some types of constructions must have a license, the rest do not have a license. Currently, we are stipulating that some types of constructions do not have a license, the rest all must have a license", Mr. Pham Trong Nghia - National Assembly Delegate of Lang Son province proposed.
Mr. Huynh Thanh Chung - National Assembly Delegate of Dong Nai province commented: "From the structure of the law, I want to specifically define many different models in the law. Although it will be more complicated in management, it is clear and assigns responsibility to the urban government to what extent it must be responsible in this matter and what guidelines and criteria must be issued. I think it will be much better if it demonstrates the transparency of the local government at that level."
During the discussion session, some delegates also noted that it is necessary to consider expanding this subject too much. Because the current planning is not standard, over-expansion, while post-audit capacity is not sufficient, will lead to difficulties in dealing with the consequences.
