Mr. Hoang Van Lien said that the Committee on Law and Justice found that the draft Resolution added 3 new contents and policies compared to the conclusion of the Politburo , so it proposed to report and ask for the Politburo's direction on these contents. The drafting agency needs to study and supplement the inspection, supervision, post-inspection, and violation handling mechanisms to properly implement the conclusion of the Politburo, which is "Strengthening the supervision mechanism, preventing corruption and negativity, thoroughly preventing and combating waste".
Regarding the content of renting social housing for enterprises, cooperatives, cooperative unions, and public service units, the Committee on Law and Justice proposed not to expand the subjects allocated social housing to "experts" to ensure compliance with the policy goals of the Party and State, which is to focus on developing social housing for low-income people, while experts have had many incentives under new policies on promoting the development of science, technology and innovation.
" At the same time, it is recommended to study and supplement regulations on state agencies being allowed to rent social housing to arrange for their civil servants to live, especially in localities implementing mergers, to facilitate the performance of official duties of these subjects, " said the Vice Chairman of the Law and Justice Committee.
Proposal to refund land clearance fees to social housing investors
Regarding the proposal for the State to refund investors in cases where investors have land use rights or agreements to receive land use rights, Mr. Hoang Van Lien said that there were many opinions that disagreed because this is a content that greatly impacts State resources but has not been assessed for policy impact and has not been reported to the Politburo. The opinion of the Ministry of Finance in the draft Resolution also expressed concerns about this content.
Another reason given by the Committee on Law and Justice is that the draft Resolution does not clearly define the time of refund, which could lead to arbitrariness in implementation, with the risk of causing loopholes and negativity.
" Some opinions agree with this policy to ensure fairness between investors who have land use rights, agreements to receive land use rights with investors who are allocated land by the State, leased land and exempted from land use fees and land rent, however, it is necessary to report to the Politburo, and at the same time, it is necessary to strictly regulate the time of return ," said Mr. Hoang Van Lien.
Previously, presenting the Government's report on the above content, Deputy Minister of Construction Nguyen Van Sinh said that the Government proposed allowing the State to refund or deduct from financial obligations the compensation, support, and resettlement costs for social housing project investors who have land use rights or receive land use rights transfers.
Accordingly, the proposed expenses to be refunded or deducted include: Land use fees; compensation, support, and resettlement costs; investment costs for construction of technical infrastructure and social infrastructure related to the creation of land funds for social housing development.
According to Mr. Nguyen Van Sinh, in the process of implementing social housing projects, there are many cases where enterprises proactively receive land use rights transfers from people, and self-invest in advance for compensation, site clearance, and investment in technical infrastructure. However, these costs are not refunded or not included in the social housing price structure, while the standard profit margin is controlled according to regulations.
" Refunding or deducting these costs will help increase the attractiveness and attract private investment in the social housing sector - a sector that plays a social security role but does not bring high profits to investors ," said the Deputy Minister of Construction.
Mr. Nguyen Van Sinh said that currently, social housing projects are exempted from land use fees. In fact, some investors who have land use rights want to switch to social housing, but according to regulations, investors who already have land use rights will not be exempted from land use fees. If land use fees are added to the cost of social housing, it will not ensure preferential treatment for low-income social housing buyers.
Mr. Nguyen Van Sinh expressed his hope that the National Assembly Standing Committee would agree to ensure fairness, and that social housing buyers would be able to buy at lower prices.
Concluding the session, Vice Chairman of the National Assembly Nguyen Khac Dinh said that the National Assembly Standing Committee assessed that the draft Resolution was qualified to be submitted to the National Assembly for consideration under the simplified procedure, and approved immediately at the 9th Session (opening on May 5).
The Vice Chairman of the National Assembly requested that the drafting committee absorb the opinions of the reviewing agency and discussion opinions to assess the specific impacts of specific policies more specifically and promptly complete the dossier to submit to the National Assembly.
