The Ministry of Finance has submitted a proposal to study and issue a policy aimed at reducing land use fees for households and individuals when converting ancestral garden land to residential land. This proposal was presented in Document No. 19084/BTC-QLCS sent to the Hanoi City National Assembly Delegation.
Reducing the financial burden on people.
According to the Ministry of Finance, this proposal stems from the fact that many households are facing difficulties with financial obligations when carrying out procedures to change the land use purpose. This burden becomes particularly heavy in the context of current land prices being much higher than agricultural land prices.

Current legal basis
Legally, the Ministry of Finance cited current regulations related to determining financial obligations when changing land use purposes. Specifically, Point a, Clause 1, Article 156 of the 2024 Land Law stipulates the principle of paying land use fees when converting from agricultural land to residential land.
Accordingly, land users must pay an amount equal to the difference between the land use fee for the land after the conversion and the land use fee for the land before the conversion, calculated for the remaining land use period.
This principle is also specified in Article 8 of Decree No. 103/2024/ND-CP for households and individuals. The land use fee payable is calculated as the difference between the land use fee based on residential land prices and the land use fee based on agricultural land prices at the time the competent authority issues the decision allowing the land use change.
Towards policies that are relevant to reality.
Based on current regulations and the actual situation, the Ministry of Finance recognizes the need for further research and policy refinement. The goal is to make the regulations more relevant to practice, thereby reducing the financial burden on the people, especially in cases where the land originates from garden land or agricultural land passed down through generations.
