According to current regulations in Article 5 of Decree 105/2012, when positions such as General Secretary, President, Prime Minister and Chairman of the National Assembly pass away, a state funeral will be held. However, the new draft adds Clause 3 to this article, clearly stating that: if those holding 1 of the 4 above positions have been dismissed by the competent authority, retired before the age, or retired due to violations, the funeral will be held according to high-level funeral rites, instead of a state funeral.
Similarly, for positions that are subject to state funerals such as: Politburo member, Secretariat member; Vice President; Deputy Prime Minister; Vice Chairman of the National Assembly; Chief Justice of the Supreme People's Court; Chief Prosecutor of the Supreme People's Procuracy; Chairman of the Central Committee of the Vietnam Fatherland Front; generals and lieutenant generals who worked before the August Revolution..., if they have been dismissed, retired due to violations or shortcomings, only high-level funerals will be held.

According to the draft amendment to Decree 105/2012/ND-CP, for individuals disciplined by dismissal, funerals will only be held according to the rituals reserved for ordinary officials, civil servants and public employees. This regulation aims to ensure a clear distinction between merits and violations, in accordance with reality and to maintain strict discipline in the personnel work of the Party and State.
The draft also mentions some adjustments to funeral forms such as sprinkling votive paper or using rotating wreaths to reduce waste and protect the environment.
