
Ho Chi Minh City People's Committee has just issued Decision No. 25/2025/QD-UBND regulating the decentralization of construction order management in the city.
Accordingly, the Department of Construction is responsible for monitoring, inspecting, detecting, preventing and handling: Construction works for which the Department of Construction issues construction permits (GPXD), construction investment decisions; construction investment projects for which the Department of Construction appraises construction investment feasibility study reports, construction designs implemented after basic designs according to the authority and according to the decentralization, authorization and adjustment of the People's Committee of Ho Chi Minh City.
In addition, there are also projects whose construction investment feasibility study reports and construction designs are appraised by the specialized construction agency under the Ministry of Construction after the basic design.

The City High-Tech Park Management Board; the City High-Tech Agricultural Park Management Board; the City Export Processing and Industrial Zones Management Board are responsible for monitoring, inspecting, detecting, preventing and handling all construction works (including works under the authority of the Department of Construction - (mentioned above)) within the boundaries of the functional areas assigned for management.
The People's Committee at the commune level is responsible for monitoring, inspecting, detecting, preventing and handling: Construction works without a construction permit, which according to regulations must have a construction permit issued by a competent state agency.
Construction works are granted construction permits and construction investment decisions by the People's Committees of communes, wards, and special zones; construction investment projects are appraised by the agency assigned to manage construction under the People's Committees of communes. Construction investment feasibility study reports and construction designs are implemented after basic designs according to the authority and according to the decentralization and authorization of adjustments of the City People's Committee.

In addition, the People's Committee at the commune level is also responsible for monitoring, inspecting, detecting, preventing and handling construction works and construction components arising after the construction has been completed and put into use or the certificate of land use rights, house ownership rights and other assets attached to the land has been updated. Construction works (not falling under the cases mentioned above, including cases exempted from construction permits).
According to the People's Committee of Ho Chi Minh City, the above management decentralization takes effect from November 20, 2025. The above Decision replaces Decision No. 41/2022/QD-UBND dated December 30, 2022 of the People's Committee of the former Binh Duong province, Decision No. 06/2023/QD-UBND dated February 17, 2023 of the People's Committee of the former Ba Ria - Vung Tau province, Decision No. 17/2024/QD-UBND dated April 1, 2025 (amended and supplemented by Decision No. 120/2024/QD-UBND dated December 14, 2024) of the People's Committee of the former Ho Chi Minh City (the above decisions are related to construction order management).

The above Decision also stipulates “transitional provisions” when implementing two-level local government. Specifically: The People’s Committee at the commune level is responsible for managing, monitoring, inspecting, detecting, preventing and handling construction works under the licensing, appraisal and approval authority of the People’s Committee at the district level (including works exempted from licensing) before July 1, 2025 but have not yet started construction, are under construction or have stopped construction.
Similarly, the Department of Construction is also responsible for handing over all records and documents related to projects under the licensing, appraisal and approval authority of the District People's Committee (including projects exempted from construction permits) before July 1, 2025 but not yet started, under construction, or suspended under the management, monitoring and inspection of the Department of Construction to the Commune People's Committee for continued management, monitoring, inspection, detection, prevention and handling according to regulations.
For projects located in the area of 2 or more commune-level administrative units, the acceptance is based on the principle of the larger construction land area.
