The National Assembly Standing Committee gave its opinion on the draft Law amending and supplementing a number of articles of 10 laws related to security and order submitted by the Government. These include the Law on Residence and the Law on Exit and Entry of Vietnamese Citizens.
The bill will be submitted to the National Assembly for consideration at its 10th session.
New proposal to amend permanent residence registration conditions
Regarding the Law on Residence, the drafting agency, the Ministry of Public Security, believes that it is necessary to resolve "bottlenecks" in the implementation of the Law on Residence.
As for the regulations on residence of minors, the conditions for permanent registration are intended to create the best conditions and protect the legitimate rights and interests of minors.
Regulations on adjusting information on residence in the Residence Database aim to reduce administrative procedures and be consistent with practice.
Notably, the draft stipulates "conditions for permanent residence registration" in the direction that minors can register for permanent residence at a legal residence that is not their own when returning to their parents or guardians.
This regulation aims to create the best conditions and protect the legitimate rights and interests of minors.
Regarding permanent residence registration dossiers, the draft clearly stipulates that in cases where minors return to live with their parents or guardians, they do not need the consent of the head of household or legal owner of the place of residence for permanent residence registration.
The drafting agency believes that not promptly amending the above regulations will not ensure consistency in implementing legal regulations.
Regarding the provisions on deletion of permanent residence registration and deletion of temporary residence registration, the Government believes that it is necessary to add cases of deletion of permanent residence registration and deletion of temporary residence registration for the cancellation of decisions on restoration of Vietnamese nationality to be consistent with the provisions of the Law amending and supplementing a number of articles of the Law on Vietnamese Nationality.
Regarding the regulation on adjusting residence information in the Residence Database, the bill clearly stipulates that when there is a change in civil status information by a competent authority, the change in civil status information of citizens will be updated from the National Population Database to the Residence Database.
Regarding the regulation on residence notification, the drafting agency believes that it is necessary to add a case where residence notification is required for vehicle managers to be consistent with practice.
Accordingly, the draft adds that the vehicle owner or the person assigned to manage the vehicle is responsible for notifying the residence. Without this provision, the timeliness and effectiveness of residence management cannot be guaranteed.
Examining this content, the Standing Committee of the National Assembly's Defense - Security and Foreign Affairs Committee agreed with the above provisions of the bill.
However, there are still opinions suggesting studying regulations on residence notification to ensure feasibility.
In addition, there are suggestions to consider regulations that allow minors to register for permanent residence to ensure convenience for minors to live with their parents or guardians, but at the same time, ensure the inviolability of the legal residence of others.
Expected new regulations on ordinary passports issued under simplified procedures
With the Law on Exit and Entry of Vietnamese Citizens, the draft adds regulations on ordinary passports issued under simplified procedures that are only valid for one-time use.
The draft stipulates that ordinary passports issued under simplified procedures are valid for no more than 12 months, cannot be extended, and are only valid for one-time use when exiting or entering Vietnam.
The draft adds a number of regulations on revocation and cancellation of passport validity, including revocation of valid ordinary passports in cases where a new passport has been issued; revocation and cancellation of passports of people who have been issued but have incorrect personal information.
Cancellation of passport validity of wanted person. The draft law stipulates that when there is a basis to determine that a wanted person has been issued a passport that is still valid, the competent authority that issued the passport will check and cancel the passport validity of the wanted person.
