Proposing new regulations on granting red books to people

(QNgTV)- The Ministry of Agriculture and Environment has proposed amending and supplementing regulations on land registration and red book issuance. This is a matter of interest to many people.

Specifically, the Ministry of Agriculture and Environment proposed to amend Clauses 2 and 3, Article 148 and Clauses 2 and 3, Article 149 in the direction that households and individuals do not need to request confirmation of the existence of the construction when issuing a red book if the documents are missing, but must be responsible for the safety of the construction. At the same time, it is necessary to supplement the regulation on issuing red books to organizations with construction works that do not comply with the documents, requiring opinions from competent authorities on safety and planning as a basis for issuing certificates.

The Ministry of Agriculture and Environment also proposed to amend Point a, Clause 1 and Clause 2, Article 133 in the direction of adding registration of changes in cases of transferring mineral exploitation rights, purchasing houses and works in real estate projects, to be consistent with specialized laws and meet digital transformation requirements.

Current law allows the transfer of mineral exploitation rights and stipulates that organizations and individuals receiving the transfer must inherit the obligations from the old license. Therefore, it is necessary to add a change registration for this case to ensure legal consistency.
