Proposal for new circular on electronic birth certificate

The Ministry of Justice has just announced the document on the review of the circular amending and supplementing Circular 01/2022 regulating the electronic civil status database and online civil status registration. The draft was drafted by the Department of Civil Status, Nationality and Authentication (Ministry of Justice), with many new proposals related to birth certificates and death certificates.

Add digital signature on electronic birth certificate

According to the Department of Civil Status, Nationality and Authentication, from April 17, this agency coordinated with units to pilot the issuance of electronic birth certificates and death certificates in Hanoi and Ha Nam. The pilot aims to be widely deployed nationwide, meeting the roadmap for implementing the Government's Project 06.

However, after a short period of implementation, in addition to the results (facilitating the connection of administrative procedures, reducing professional operations for civil servants, etc.), the pilot has some problems that need to be resolved.

Typically, electronic birth certificates and death certificates, when created, do not have the digital signature of the issuing agency, so they do not have enough information to handle administrative procedures, causing concerns about their legal value.

This problem was once reported by Thanh Nien in the article "Chip-embedded ID cards are slow to become 'universal keys'". Accordingly, in Hanoi - one of the two localities selected for the pilot, the Ministry of Justice deployed the issuance of electronic copies of birth certificates and death certificates, but the local police agency did not agree to accept them because there was no red seal.

Another issue also mentioned by the drafting agency is that birth registration information has a "dynamic" nature, meaning that it is likely to change after registration (change of name, correction or addition of civil status information, re-identification of ethnicity, etc.).

Therefore, the electronic civil status document will only record basic information related to the individual's civil status event. For example, the electronic birth certificate will include the last name, middle name, first name, identification number of the person being registered, the full names of the parents, and the place of birth registration.

On the electronic version, civil status papers will have a QR Code, which is the "key" for individuals, agencies, and organizations to connect to the electronic civil status database, check authenticity, and provide real-time updated civil status information when handling related administrative procedures.

Along with the above proposals, the Department of Civil Status, Nationality and Authentication has drafted detailed appendices on electronic birth certificate forms and death certificate extracts, for unified implementation in case the circular is issued.

People do administrative procedures in Hanoi

From July 10th will be deployed nationwide

On June 30, at the Government Office , more than 500 leaders and officials of the Ministry of Justice, Ministry of Health, Ministry of Labor, Invalids and Social Affairs, Vietnam Social Security and People's Committees of several provinces and cities participated in training on the implementation of two groups of interconnected administrative procedures including "birth registration, permanent residence registration, health insurance card issuance for children under 6 years old" and "death registration, permanent residence cancellation, funeral cost support, funeral allowance".

The training content focuses on instructions on using the public service software such as: instructions on logging into the national public service account (can log in with the VNeID electronic identification account), creating and submitting public service records, and searching records.

Along with that, the electronic interconnected settlement process for the group of administrative procedures "death registration - permanent residence cancellation - funeral allowance" on the National Public Service Portal, the process of receiving dossiers to resolve interconnected administrative procedures for issuing health insurance cards for children under 6 years old...

The Department of Administrative Police for Social Order of the Ministry of Public Security said that from July 10, the two above-mentioned connected public services will be deployed nationwide, helping people reduce time and costs of going to work, because they only need to do it once but can solve 3 accompanying administrative procedures.

According to regulations, the time limit for returning birth certificates, registering permanent residence, and issuing health insurance cards for children under 6 years old takes 15 days. Now, when connected and implemented through the Public Service Portal, it only takes 2 days to complete all 3 procedures./.
