The Ministry of Construction has sent documents to the Prime Minister requesting that localities be the managing agencies of 5 expressways including: Bac Kan-Cao Bang, Tuyen Quang-Ha Giang (phase 2), Vinh-Thanh Thuy (Nghe An), Quang Ngai-Kon Tum and Quy Nhon-Pleiku.
For the above 5 expressways, which have not yet formed assets, the Ministry of Construction stated that it will apply the provisions of the law on public investment. Specifically, Clause 4 and Clause 11, Article 4 of the Law on Public Investment stipulates that "Ministries, ministerial-level agencies and localities are the competent authorities assigned by the Prime Minister ". The head of the Ministry of Construction further emphasized: "The Prime Minister's assignment of competent authorities to localities is in accordance with the provisions of the law on public investment".
In recent times, many expressway projects such as Chau Doc-Can Tho-Soc Trang, Khanh Hoa-Buon Ma Thuot, Bien Hoa-Vung Tau, Tuyen Quang-Ha Giang (phase 1), Hoa Binh-Moc Chau, Ninh Binh-Nam Dinh-Thai Binh-Hai Phong, Ring Road 3, Ring Road 4-Ho Chi Minh City..., have been assigned by the Prime Minister to localities as the managing agencies similar to the 5 expressways mentioned above for implementation.
Implementing the Party's policy on promoting decentralization and delegation of power as defined in the Resolution of the 13th National Congress and to ensure project implementation progress, in accordance with the direction of the Prime Minister, the Ministry of Construction proposes that the Prime Minister soon consider and decide on assigning localities as the governing bodies of the 5 expressways, as a basis for localities to proactively implement to meet the required progress.
