At the Conference on the implementation of decentralization of state management of education in the two-level local government model held on the morning of August 5, representatives of specialized departments and bureaus of the Ministry of Education and Training directly answered many questions from localities. Many questions related to authority, coordination mechanism, responsibility for professional guidance at the commune level... were clarified. Below is a summary of some notable contents.

Strengthening guidance and inspection of the implementation of decentralization of education management from provincial to communal levels.
Director of the General Education Department Thai Van Tai: The authority has been clearly defined in Decree 142/2025/ND-CP (Decree 142), Decree 150/2025/ND-CP (Decree 150), which clearly state the roles, positions and responsibilities. The coordination regulations from the department level down are implemented in accordance with the spirit of decentralization of authority. In the context of a two-level local government, the Department needs to focus on professional management, including: information - reporting regime, professional deployment, meetings, continuous information... This is under the authority of the Department of Education and Training.
Director of the General Education Department Thai Van Tai: Yes. According to Decree 142, 143/2025/ND-CP (Decree 143), Circular No. 10/2025/TT-BGDDT (Circular No. 10) and Circular No. 15/2025/TT-BGDDT (Circular No. 15), the Department is responsible for unifying expertise across the province, providing guidance and training for commune-level officials. In addition, it is necessary to organize implementation conferences at the commune level to ensure proper implementation in the new context.
Director of the General Education Department Thai Van Tai: Yes. This content is clearly stipulated in Circular No. 10 and Decree 142. The current problem is not that there are no regulations but that they have not been fully implemented from the provincial level down.
Head of the General Education Department Thai Van Tai: There is currently a situation where communes issue professional documents beyond their authority, due to old habits when officials used to work at the Department of Education and Training. To rectify this, Deputy Minister Pham Ngoc Thuong has directed the implementation of Plan 1055, organizing 6 inspection teams in 34 provinces next week, each team working with 5-6 departments, to grasp the current situation of implementing two-level local government. After the inspection, the Ministry will issue a document guiding the implementation, avoiding exceeding authority.
Director of the Department of General Education Thai Van Tai: There is no authority to adjust the school year plan unless it is a case of force majeure.
Currently, there is no provision in Circular 10, Decree 142, Decree 143 granting this power to the Chairman of the Commune People's Committee.
However, according to the school year time frame decision issued annually by the Ministry of Education and Training, the Chairman of the Provincial People's Committee has the right to adjust it to suit local conditions. In particular, if natural disasters or sudden epidemics occur, schools can be flexibly closed to ensure safety.
But if the reason for adjustment is due to festivals or agricultural production (forecasted in advance), the time frame issued by the Provincial People's Committee must be strictly followed.
Recommendation: The Department of Education and Training should add specific instructions in the document implementing the school year's tasks.
Director of General Education Department Thai Van Tai: There is no overlap.
According to Circular 10, the principal and the secondary school council organize teaching, review meetings and propose graduation recognition. Previously, the Department of Education and Training submitted to the Chairman of the District People's Committee. Now, according to the new decentralization, the authority to grant degrees belongs to the Commune People's Committee.
Meaning: School: organizes the recognition and confirmation of results; Commune People's Committee: recognizes and grants diplomas. This content has been clearly stated in Circular 15, stating that the Chairman of the Commune People's Committee grants junior high school graduation diplomas.
Director of General Education Department Thai Van Tai: It is necessary to increase the issuance of guiding documents in accordance with local authority. There are documents that need to be issued early before implementing the school year's tasks. It is necessary to organize specialized conferences from the provincial level down to the district and commune levels to unify the implementation method. The Ministry will compile a question and answer handbook and send it to localities immediately after the conference to serve professional work.

Decentralization of preschool education management: Ministry of Education and Training adjusts to be consistent with the Law and local practices
Deputy Head of the Department of Preschool Education Cu Thi Thuy: In Article 5 of Decree 105/2020 of the Prime Minister, it does not mention the People's Committee at the district level but clearly states that the People's Committee at the provincial level develops plans, support plans, and plans to inspect the use of funds for independent preschools and submits them to the People's Council at the provincial level. Therefore, the provinces assign to which unit the authority of the Provincial People's Committee is the authority of the Provincial People's Committee. This is under the authority of the Provincial People's Committee.
Deputy Head of the Department of Preschool Education Cu Thi Thuy: We have revised and supplemented this content in Circular 15/2025/TT-BGDDT on guiding the functions, tasks and powers of the Department of Education and Training under the People's Committees of provinces and centrally-run cities and the Department of Culture and Social Affairs of the People's Committees of districts, towns and cities in the areas in the field of preschool education. In which, at Point b, Clause 2, Article 5, stipulates: The Department of Culture and Social Affairs submits to the Chairman of the People's Committee at the commune level to decide on the establishment, permission to establish, operate, suspend, merge, separate, dissolve and convert educational institutions under the local authority. At Point a, Clause 3, Article 7, amend the phrase "Director of the Department" to "Chairman of the People's Committee at the commune level" - consistent with the decentralization of Decree 142 and the Law on Organization of Local Government.
Deputy Director of the Department of Preschool Education Cu Thi Thuy: The Ministry of Education would like to receive opinions from localities. Currently, the Ministry is being assigned by the Government to develop a Decree on universalizing preschool education for children aged 3 to 5. The Ministry will study and advise the Government to amend regulations on the authority to recognize universal preschool education standards as soon as possible to implement Resolution 218 issued by the National Assembly.
Deputy Head of the Department of Preschool Education Cu Thi Thuy: Responsibility for professional guidance: belongs to the Department of Education and Training. Responsibility for supervising activities: belongs to the People's Committee at the commune level, according to Clause 3, Article 23 of Circular 49.
The Commune People's Committee can build a community-based monitoring mechanism, encouraging people to participate in monitoring child care and education activities in the locality, ensuring comprehensive development.
Deputy Head of Department Cu Thi Thuy Preschool Education Department : Management of preschool education facilities in the area is under the authority of the Chairman of the People's Committee at the commune level, implemented in Clause 2, Article 23 of the Law on Organization of Local Government and Clause 3, Article 42 of Decree 142 dated June 12, 2025, which stipulates the division of authority of two-level local governments at the commune level.

Regulations on organization and operation of other centers performing continuing education tasks?
Deputy Director Department of Vocational Education and Continuing Education Nguyen Xuan Thuy : Pursuant to Article 4 of Decree No. 125 of the Government and Circular No. 11 of the Ministry of Education and Training, the Ministry is currently drafting circulars detailing the regulations on the organization and operation of the above centers. Draft circulars have been sent to the departments of education and training for comments. The circulars are expected to be issued in early 2026 to meet the requirements of educational management innovation and meet the lifelong learning needs of the people.
Deputy Director of the Department of Vocational Education and Continuing Education Nguyen Xuan Thuy: Similar to preschool and general education institutions, community learning centers continue to operate according to current regulations. Specifically, according to Circular No. 09/2008 of the Ministry of Education and Training and Circular No. 96/2008 of the Ministry of Finance on organization, operation and funding support mechanism. The planning of the network of community learning centers is under the authority of the Chairman of the Provincial People's Committee, based on Decrees 142 and 143 of the Government. The planning must ensure that each commune has at least one community learning center.
Currently, the Ministry of Education and Training is surveying and assessing the current situation to develop new regulations for community learning centers, expected to be issued in early 2026. In addition, the Ministry has sent Official Dispatch No. 3891 dated July 11, 2023 to the Ministry of Finance, requesting the early issuance of a circular to replace Circular 96 to suit the current context.
Deputy Director of the Department of Vocational Education and Continuing Education Nguyen Xuan Thuy : Currently, according to Decree No. 142, the authority to recognize communes that have met the standards for universalization and illiteracy eradication has been transferred from the People's Committees at the district level to the People's Committees at the provincial level. Localities need to review and adjust internal procedures, ensuring that the inspection, evaluation, appraisal of records and issuance of recognition decisions are carried out within the authority and in accordance with regulations. The Ministry of Education and Training will soon issue detailed instructions to ensure consistency in implementation nationwide, avoid overlap, ensure the rights of learners and the effectiveness of universalization and illiteracy eradication.
