Adjusting investment policy for the project to complete the Ta Pao irrigation area

On August 17, 2021, the Provincial People's Council issued Resolution No. 24/NQ-HDND approving the investment policy of the Project to complete the irrigation system of Ta Pao, Binh Thuan province to solve the irrigation water source for about 670 hectares of agricultural land along the North main canal to stabilize the lives and production of people in Huy Khiem, Bac Ruong and Mang To communes, Tanh Linh district; solve the irrigation water source for about 554 hectares of agricultural land in the irrigation area of Duc Binh pumping station and Dong Kho pumping station (old).

However, due to the fact that the process of preparing the Investment Proposal Report was only preliminary, the preliminary design documents for the project location were based on the results of field inspections and the Ta Pao irrigation system map at a scale of 1/10,000. Accordingly, the investment content and scale approved in Resolution No. 24/NQ-HDND before, did not accurately calculate the flow rate to select pumps according to terrain conditions, specific conditions in the irrigation area; the canal arrangement still intersects many residential land and houses, has not taken advantage of traffic routes to make canal banks, and has not been well connected with the existing intra-field canal system to minimize compensation and site clearance areas.

Up to now, after the survey process, the project feasibility study report of the consulting unit has organized the measurement and drawing of the irrigation area map at a scale of 1/5,000, calculated and determined the capacity of the pumping station, selected the type of pump available on the market to meet the design standards to ensure safe and effective operation. Accordingly, the canal system, pipeline system and works on the canal have been studied and rearranged to suit the results of the topographic survey to maximize the capacity of the canals and synchronously connect with the existing canals, reduce the length of the canal, minimize the land area for construction works, ensure convenience for management and operation, and maximize the effectiveness of the project.

Therefore, it is necessary to review and adjust the content and scale of investment to ensure that the total investment does not change and still ensure the original objectives of the project, as a basis for implementing the next steps of the project.

According to the provisions of Clause 1, Article 11 of Decree No. 40/2020/ND-CP dated June 4, 2020 of the Government : In case the program or project has been decided on investment policy by a competent authority but has not yet decided on investment, if there is a change in the content of the investment policy decision, the adjustment of the investment policy shall be implemented in accordance with Article 34 of the Law on Public Investment.

Pursuant to Clause 1, Article 34 of the 2019 Law on Public Investment, the submission of the Provincial People's Committee to the Provincial People's Council for approval of the adjustment of the investment policy for the Project to complete the irrigation system of Ta Pao, Binh Thuan province is appropriate.

This is a Group B project with a total investment of 100 billion VND, the project implementation period according to regulations is 4 years, from the time the Provincial People's Council approved the investment policy for the Project to Complete the Irrigation System of Ta Pao, Binh Thuan Province according to Resolution No. 24/NQ-HDND dated August 17, 2021 to now, it has been nearly 2 years. Therefore, to ensure that the project is implemented on time as prescribed, the Provincial People's Committee is requested to direct the investor and related units to urgently take the next steps to soon deploy and put the project into operation. The draft Resolution is built with sufficient legal basis, within the correct authority, in accordance with regulations and ensuring legality and consistency with the current legal system.

Amend Clause 2, Article 1 of Resolution No. 24/NQ-HDND dated August 17, 2021 of the Provincial People's Council as follows:
Investment content and scale:
- Bac Ruong pumping station on the North main canal: Investing in the construction of headworks, pipelines and irrigation canal systems, equipment and auxiliary works with dimensions, flow rates and structures meeting technical standards and ensuring irrigation water for 670 hectares of agricultural land.
- Duc Binh pumping station on the South main canal: Investing in the construction of headworks, equipment and auxiliary works with dimensions, flow rates and structures meeting technical standards and ensuring irrigation water for 554 hectares of agricultural land.
