
On the morning of November 4, continuing the 10th Session, the National Assembly discussed in groups the draft Law amending and supplementing a number of articles of the Law on Judicial Records.
Discussing in groups, National Assembly deputies commented that the new points in the draft Law amending and supplementing a number of articles of the Law on Judicial Records have basically followed reality; met the requirements of promoting the application of science and technology in building databases and cutting administrative procedures.
Proposal to expand the authority to issue criminal records to commune-level police
Regarding the classification of Criminal Records, delegate Vu Hong Luyen ( Hung Yen Delegation) pointed out the fact that many agencies abuse the requirement for people to submit Criminal Records No. 2, which includes the cleared criminal record, affecting their reintegration into the community. Therefore, the delegate proposed to consider issuing only one type of certificate to individuals, without distinguishing between Certificates No. 1 and No. 2.
At the same time, delegates proposed reducing the verification period for issuing Criminal Records from 15 days to 10 days to comply with digital transformation.

Giving comments to complete the draft Law, delegate Nguyen Van Quan (Can Tho City Delegation) proposed to expand the authority to issue Criminal Records Certificates to commune-level police to facilitate people's implementation and also in line with the spirit of Directive No. 23 of the Prime Minister on promoting administrative procedure reform, creating favorable conditions for people and businesses.
The delegate raised the issue: In the current two-level local government organization, if people have to go to the provincial or city police center to get their criminal records, many localities are very far away. Currently, the databases have been connected. "Perhaps we can consider upgrading the facilities of communes and wards to gradually implement this procedure for people at the commune level."
In that spirit, delegate Nguyen Van Quan suggested that the drafting agency consider and design a provision on the interconnection mechanism for relevant agencies to exploit data on criminal records through specialized databases of relevant agencies in performing administrative procedures without forcing people to submit Criminal Records.

Expressing his agreement with the above proposal, delegate Hoang Thanh Tung (Can Tho Delegation), Chairman of the Law and Justice Committee, said that the proposal to expand the authority to issue Criminal Records to commune-level police should be studied because it is consistent with the policy of promoting decentralization and infrastructure conditions, connecting databases as present, at the same time, creating favorable conditions for people. data as present, so that commune police can access and issue Criminal Records to citizens upon request.
The Chairman of the Law and Justice Committee said he will coordinate with the drafting agency to research, absorb, and report to the National Assembly Standing Committee and the National Assembly on the above content.
Simplify ticket issuance procedures, focus on data security
Speaking at the meeting, National Assembly Chairman Tran Thanh Man said that people are looking forward to reforming the procedures for issuing criminal records. This time, the amendment of the Law must ensure the simplification of documents, reduce time, promote online implementation; free for children, the elderly, the disabled, poor households, promote level 4 public services... This issue will facilitate people because currently most job applications and paperwork require a criminal record.
Noting that currently 10% of data is faulty due to manual transfer, the National Assembly Chairman suggested that the draft Law should stipulate a roadmap for digital transformation to reach 100% by 2026.

Regarding the reform of procedures for issuing Criminal Records Certificates, the National Assembly Chairman emphasized that this is very necessary content. Accordingly, it is necessary to simplify the dossier, reduce the time for issuing certificates and increase the online issuance of certificates, creating more convenience for the people.
National Assembly Chairman Tran Thanh Man said that it is necessary to refer to the model of other countries in looking up criminal records to ensure data integrity and avoid illegal editing.
The National Assembly Chairman also noted that attention must be paid to data security risks, especially sensitive data such as personal criminal records. According to the National Assembly Chairman, in the revised Criminal Records Law Project, it is necessary to add specific regulations on cybersecurity, in the spirit of the 2018 Cyber Security Law and this revised Cyber Security Law. In the construction and management of criminal records data, it is possible to add regulations on data standards to avoid data abuse.
The National Assembly Chairman requested the Review Agency to coordinate with the Drafting Agency to continue to carefully review and listen to multi-dimensional opinions to continue perfecting the draft Law.
