Dong Nai's welcome drastic move

Unfortunately, this resource has not been managed and used in accordance with legal regulations, so recently the People's Committee of Dong Nai province has decided to reclaim the land; a move that is considered very drastic, quick, reasonable, appropriate, and welcome.

The above land was assigned by the province to a famous Vietnamese enterprise to do the project nearly 20 years ago. Specifically, in mid-2006, the land was assigned to do the project, then adjusted in 2008, the project's goal was to build a residential - commercial area, contributing to the development of urban and service areas in Nhon Trach, one of the key areas of Dong Nai, next to Ho Chi Minh City and directly connected to Long Thanh International Airport. The enterprise has completed its financial obligations with the land. The red book was issued to the enterprise at the end of 2008.

Unfortunately, this prime project has not yet been implemented. In 2023, the Provincial People's Committee extended the land use period for the enterprise by 16 months, with the requirement to start construction of the project before January 17, 2025. However, after the above deadline, at the time of inspection in May 2025, Dong Nai authorities assessed that the investor had not yet started construction or fulfilled investment commitments, so they proposed that the Provincial People's Committee decide to revoke it.

According to the Land Law, land allocated by the State but not put into use within the prescribed period, or after the extended period, will be recovered without compensation.

The Provincial People's Committee then issued a decision to reclaim the land without compensation for the land and assets attached to the land; requested the enterprise to comply with the decision to reclaim, remove all assets and equipment from the land; hand over the current status to the Provincial Land Fund Development Center for management; hand over the red book to the Department of Agriculture and Environment for storage. The Nhon Trach District People's Committee was assigned to coordinate with relevant units to supervise the process of reclaiming and handing over the land. In case the enterprise does not cooperate, the District People's Committee is responsible for enforcement according to the law.

The public is concerned about the above incident because the subject of the incident is a land of extremely high value, the investor of the project is a famous enterprise and the violation in putting the land into use has lasted for a long time. However, overcoming the pressure, the People's Committee of Dong Nai province has taken a decisive action, in accordance with the law. The public also expects this to be a move to pave the way for a plan to thoroughly handle projects that are still behind schedule in using land in Dong Nai; to mobilize land resources for the socio -economic development of the locality in particular and the country in general; and also a way to propagate for land users to properly exercise their rights and obligations as prescribed by law.
