Request to stop raising capital
On June 27, the Department of Construction of Khanh Hoa province sent a document to Napoleon Company Limited - the investor of Hoang De apartment building at 04-06 Bac Son street, Vinh Hai ward, Nha Trang city about putting future real estate into business.
According to the Department of Construction, the website https://celadoncity-gamuda.com/ is currently posting advertising information for selling apartments at the project (access link: https://celadoncity-gamuda.com/the-landmark-nha-trang.html).
The project information includes: “The Landmark Nha Trang consists of 34 floors with a total of 434 apartments. The project is located at 04-06 Bac Son Street, Vinh Hai Ward, Nha Trang City, Khanh Hoa Province. The investor of the project is Napoleon Company Limited, a reputable and experienced unit in the real estate industry”.
Khanh Hoa Provincial Department of Construction said that according to Construction Permit No. 09/GPXD dated December 8, 2023, the Hoang De apartment building has the following floors: 2 basements, 20 floors above ground, 1 elevator penthouse. At the same time, the Hoang De apartment project has not yet been allowed to put real estate into business according to legal regulations.
The activities of opening for sale, putting the project's real estate products into business to collect money from customers through forms such as: reservation contracts (registration of places); deposit contracts; capital mobilization contracts; capital contribution contracts; loan contracts... the purpose of these contracts is to prioritize registration, deposit, and enjoy the right to buy a house (if any) is not in accordance with the provisions of law.
Accordingly, the Department of Construction requests Napoleon Company Limited to immediately stop the above activities and not authorize real estate trading floors and businesses to offer, open for sale, advertise, and promote the sale of real estate of the project (if any). At the same time, remove advertisements for real estate of the above project issued by the company and its business partners, posted on the media and electronic information websites (if any).
Khanh Hoa Province Department of Construction also requested Napoleon Company Limited to take intervention measures to require real estate trading floors, real estate businesses, organizations and individuals who are selling the project's products without permission from the investor to stop this activity.
In case the above individuals and units continue to offer and advertise the sale of real estate of the project illegally, Napoleon Company Limited is responsible for promptly reporting to the authorities for strict handling according to the law.
“In the immediate future, the investor needs to contact the website owner that is currently posting advertising information about the sale of apartments in the above project to request corrections and removal of inappropriate and inaccurate information about the Hoang De Apartment project” – Khanh Hoa Province Department of Construction requested.
Khanh Hoa Province Department of Construction also said that if the company conducts sales activities, puts the project's real estate into business to collect money from customers in any form without a written notice of consent from the Department of Construction, it will be strictly handled according to the law.
Not allowed to add floors
According to the reporter's investigation, on June 6, 2024, EXIMRS Real Estate JSC - the exclusive distributor of The Landmark Nha Trang project, had a booking policy for customers who want to register for consultation on apartment products at the above project.
Specifically, customers from 1-150 will receive a gift of 2 taels of gold/each product with a successful deposit; customers from 151-300 will receive a gift of 1 tael of gold/each product with a successful deposit; customers from 301-500 will receive a gift of 5 million VND/each product with a successful deposit. The application period is from June 12.
According to the price list and payment schedule of EXIMRS Real Estate JSC advised to customers on June 26, the expected deposit contract signing date is August 4 is 5% of the apartment value (including the booking fee of 20 million VND). Signing the sales contract after 60 days of signing the deposit contract (expected October 2024) is 20% of the apartment value.
After that, 5% of the apartment value will be paid in installments every 30 days. If paid according to this schedule, customers will receive a 2% discount on the total apartment value.
It is worth mentioning that the project is currently only licensed to build 2 basements, 20 floors above ground, and 1 elevator shaft, but brokers still introduce the project as 34 floors high.
According to the reporter's investigation, on December 29, 2023 (ie 21 days after being granted a construction permit), the investor submitted a document on the appraisal and approval of the master plan for the construction of the Hoang De apartment project. The document stated that the land area is 2,013.6 m2, the land use area is 1,958 m2. The construction height for the high-rise apartment building is 34 floors (excluding the elevator shaft) and 1 basement. The land use coefficient is about 12.79 times.
According to the Department of Construction, the investor has requested to adjust the height of the floors but has not yet received permission from the competent authority. In addition, with the land use coefficient standard of 13 times, it is difficult to go up to 34 floors because the land use coefficient for 20 floors is already 12.7 times.
