Nearly 1.4 million vehicles could have their inspection cycle automatically extended by 6 months

Nearly 1.4 million non-commercial vehicles with up to 9 seats will have their inspection deadline postponed by 6 months according to the draft Circular amending and supplementing a number of articles of Circular No. 16/2021/TT-BGTVT.

Deputy Minister of Transport Le Dinh Tho has just signed Document 5341//BGTVT-KHCN&MT to send to the Ministries of Public Security, National Defense, Justice, Finance, Science and Technology, Natural Resources and Environment, Industry and Trade and Vietnam Insurance Association to solicit comments on the draft Circular amending and supplementing a number of articles of Circular No. 16/2021/TT-BGTVT regulating technical safety and environmental protection inspection for road motor vehicles according to simplified procedures.

Notably, the draft Circular adds the content that the inspection agency automatically issues confirmation of the extension of validity of certificates and inspection stamps for vehicles participating in traffic, helping to fundamentally resolve the current congestion in motor vehicle inspection, well meeting the inspection needs of people and businesses.

The draft clearly states: The subjects of application are passenger cars with up to 9 seats that are not used for transportation business and whose inspection period expires within 1 year from the date the Circular is issued. The inspection period will be automatically extended according to the new period prescribed in Circular 02/2023/TT-BGTVT.

For example, this regulation takes effect from June 2023 and only applies to vehicles with inspections from June 2023 to the end of June 2024.

Thus, the continued validity period of the inspection certificate and inspection stamp in any case shall not exceed December 31, 2024.

For example, a car with less than 9 seats manufactured 5 years ago, whose current inspection cycle expires on June 30, 2024 (the last day of the regulation's validity period), will still have its inspection cycle automatically extended by 6 months (from 18 months to 24 months according to the new cycle), and by December 31, 2024, the inspection certificate and inspection stamp will expire. At this time, the new car owner must take the car for inspection to continue a new inspection cycle.

This means that vehicles that have an inspection deadline before the effective date of the Circular (even though there are cases where they have not been inspected due to vehicle inspection overload) will not be subject to the new inspection cycle specified in Circular 02/2023 of the Ministry of Transport and will still have to go to vehicle inspection centers to be granted certificates and inspection stamps. According to the calculation of the Department of Vehicle Inspection, there will be more than 155,000 vehicles in this category.

This is based on the recommendations of the Department of Insurance Management and Supervision ( Ministry of Finance ), Motor Vehicle Insurance Companies and the Traffic Police Department due to concerns about the existence of cases where vehicles have been recorded as administrative violations, have been denied compensation or have been handled by competent authorities because their inspections have expired before the effective date of the Circular. These cases cannot be implemented because they are entangled with other legal regulations.

According to statistics from the Vietnam Register, nearly 1.4 million non-commercial vehicles with up to 9 seats will have their inspection deadlines postponed by 6 months. This means that the inspection units will have time and resources to inspect commercial vehicles and other vehicles whose registrations have expired but have not been inspected.

According to Circular 02/2023/TT-BGTVT effective on March 22, 2023 amending and supplementing a number of articles of Circular No. 16/2021/TT-BGTVT regulating technical inspection and environmental protection of road motor vehicles, the groups of vehicles whose inspection cycles are adjusted by 3 months or 6 months compared to the previous inspection cycle include: passenger cars with up to 9 seats not used for transportation business (with a production time of up to 7 years and a production time of 13 years to 20 years); passenger cars with over 9 seats with a production time of up to 5 years; trucks of all kinds, tractors manufactured for 20 years or more.

According to the Vietnam Register, the group of passenger transport vehicles with more than 9 seats have been manufactured for up to 5 years, trucks of all kinds, and tractors manufactured for 20 years or more have high usage intensity, and are operated and used by many different people, so the maintenance, care, and preservation regime is not good.

According to inspection statistics, the pass rate from the first inspection for this group of vehicles is very low (at times only reaching 67.6%).

Meanwhile, the group of passenger cars with up to 9 seats that are not used for commercial transportation and are due for monthly inspection is large in number, accounting for about 33 - 43% of the total number of vehicles due for inspection, especially in Hanoi and Ho Chi Minh City.

This is a group of privately owned vehicles, which are basically not used much, vehicles are valuable assets of the people and directly affect the health and life of the vehicle owner and their family and relatives. Therefore, the care, maintenance and repair of the vehicle owner is better than that of vehicles used for business purposes.

According to statistics, the passing rate from the first inspection of this group of vehicles is very high (in 2020 it was 95.84%, in 2021 it was 96.33% and in 2022 it was 95.12%).

Based on the analysis of the actual situation and recommendations from people, businesses, transport associations... and at the same time putting the interests of the people and the country first, the Vietnam Register and the Ministry of Transport agreed to immediately apply the inspection cycle as prescribed in Circular No. 02/2023/TT-BGTVT for passenger cars with up to 9 seats that are not used for transport business and have been granted an inspection certificate and inspection stamp without the vehicle owner having to bring the vehicle to the inspection center for re-inspection.

From there, it creates conditions for inspection units to focus human resources and facilities to mainly serve the inspection of other transport business vehicles as well as vehicles that are overdue for inspection but have not been inspected to both resolve congestion and ensure early putting of vehicles into operation, minimizing unnecessary damage to society.

For example: avoiding losses of thousands of billions of VND to society, because according to reports from transport associations, transport business vehicles lose from 1 to 5 million VND/day if they are not inspected for operation and unidentified losses such as: wasting time waiting, causing harm to people's health and spirit and creating bad public opinion in society, causing insecurity and disorder, taking advantage of traffic jams for profit, causing disruptions in the supply chain, affecting the efficiency and growth rate of the economy; affecting foreign investment attraction in Vietnam as well as affecting the image of the country.

Therefore, this is a completely practical and feasible solution when implemented. And according to the calculation of the Vietnam Register, with this new regulation, when applied, it will help resolve the traffic jam in about more than 1 month.
