(PLVN) - The number of trade defense lawsuits (TDS) in major markets is increasing, which will have a huge impact on export turnover. Therefore, the Ministry of Industry and Trade continues to promote TDS measures to respond to cases investigated and applied by foreign countries to Vietnam's export goods.
The United States uses the most trade defense measures.
According to the report of the Ministry of Industry and Trade, up to now, there have been 270 trade remedy cases from 25 markets and territories investigating Vietnam's export goods. Of which, the leading cases are anti-dumping investigations (148 cases), followed by self-defense cases (54 cases), anti-evasion of trade remedy measures (38 cases) and anti-subsidy cases (30 cases).
In 2024 alone, there will be 28 new PVTM cases initiated by foreign investigations arising from 12 markets, of which 13 cases will come from the US market, followed by the ASEAN market, Canada, Korea, etc.
Most recently, the US Department of Commerce (DOC), in its announcement of its decision to extend the administrative processing period in anti-dumping and countervailing duty investigation procedures, "revealed" information showing that, most likely, the US's anti-dumping and countervailing duty investigations with other countries have not yet stopped.
Specifically, according to DOC, in fiscal year 2024 (October 1, 2023 - September 30, 2024), DOC received 117 new petitions from domestic industries requesting the initiation of antidumping and/or countervailing duty investigations - this number of petitions exceeded the previous all-time high (FY 2020). Notably, in just the first 2 months of fiscal year 2025 (starting October 1, 2024), DOC received 25 additional petitions.
A representative of the European-American Market Department (Ministry of Industry and Trade) said that the United States is also the country that applies the most trade remedies measures on Vietnamese export goods, including anti-subsidy and anti-dumping investigations, focusing on key export items such as wooden furniture, seafood, textiles, footwear, etc.
The investigations are aimed at determining whether these products are subsidized by the government or sold at a price below their actual value, causing damage to the US manufacturing industry. In addition, the US also tightens regulations to prevent transshipment and fraudulent origin to gain benefits.
The representative of this Department noted that the United States also changed the annual review process towards increasing transparency and efficiency in implementing SPS measures, creating greater pressure on Vietnamese export enterprises.
Early warning list of risky items to watch out for
Faced with increasing challenges from trade remedies measures of the United States in particular and other major markets of Vietnam in general, the Trade Remedies Authority (Ministry of Industry and Trade) recommends that Vietnamese enterprises need to deploy synchronous solutions to minimize risks and maintain competitive position.
Strict compliance with US and importing country regulations is a prerequisite, including transparency in production processes and building a clear traceability system to meet legal requirements and increase trust from partners and customers.
At the same time, businesses need to cooperate closely with competent authorities and industry associations to promptly grasp changes in trade policies of importing countries, thereby building effective response strategies. Measures to diversify export markets and input material sources to reduce dependence on a single market and limit negative impacts from trade remedies are also noted by the Ministry of Industry and Trade.
In addition, the Department of Trade Remedies has also updated the warning list of goods at risk of being investigated for trade remedies and preventing trade remedy evasion (the list is updated at the end of each quarter) and sent it to the Ministries, branches, provincial People's Committees, associations, and related enterprises for coordination and monitoring. Therefore, enterprises need to pay attention to the goods that the Department has warned about, to avoid falling into a situation where they may be considered for trade remedy investigation.
In fact, according to the Ministry of Industry and Trade, the work of early warning and supporting businesses in responding to trade remedy cases initiated by foreign countries investigating Vietnamese export goods in recent times has brought about some positive results. Thanks to that, exporting businesses are not subject to trade remedy taxes or are subject to low taxes, contributing to maintaining and expanding export markets.
In case of investigation, the Ministry of Industry and Trade recommends that enterprises should proactively cooperate and provide full relevant documents to prove the appropriateness of the prices offered in the consumption markets. At the same time, proactively coordinate with ministries, branches, localities, associations, and enterprises to effectively handle the situation between export enterprises that are not subject to trade protection tax or are subject to low tax rates, contributing to maintaining and expanding export markets.
Domestically, to date, the Ministry of Industry and Trade has initiated investigations into 30 trade remedy cases and applied 22 measures to imported goods; there are currently 16 trade remedy measures in effect. In 2024, the Ministry of Industry and Trade will continue to investigate and review 7 cases initiated in 2023; initiate investigations into 3 new cases, initiate reviews of 3 end-of-term reviews; receive and process 7 new investigation and review requests.
