On August 17, the Provincial People's Council's Supervisory Delegation led by Comrade Nong Van Tuan, Head of the Provincial People's Council's Legal Committee, supervised the implementation of Resolution No. 33/2017/NQ-HDND dated December 8, 2017, Resolution No. 34/2017/NQ-HDND dated December 8, 2017 of the Provincial People's Council on the level of expenditure to ensure the dissemination andeducation of law (PBGDPL) and standards of legal access for people; some levels of expenditure for grassroots mediation work in the province at the Department of Justice.
As the standing body of the Provincial Coordination Council for Legal Dissemination, the Department of Justice advises on the issuance of plans to implement legal dissemination projects under the guidance of central ministries and branches, ensuring the right focus, key points, and suitability to the local situation. Every year, the Department issues documents and regularly coordinates with units and localities in allocating funds for legal dissemination, legal access standards and mediation at the grassroots level through inspection activities, professional guidance integrated into the professional activities of the sector.
Currently, the province has 122 provincial reporters and 255 District-level reporters and 2,286 commune-level propagandists performed the task of legal dissemination at agencies, units and localities; 148/161 communes, wards and towns met the standards of legal access, accounting for 91.9%; maintained the operation of 130 legal bookcases in extremely disadvantaged communes. The Department regularly monitors, guides, issues inspection plans and organizes inspections of the implementation of legal dissemination work, on average inspecting 3-4 district-level units/year. The province has 1,462 mediation teams/7,992 mediators who are prestigious, knowledgeable about the law, and capable of mobilizing and persuading the people. From the implementation of the Law on Mediation at the Grassroots Level in 2013 to June 2023, the mediation teams received and mediated 9,103 cases, successfully mediated 5,820 cases (accounting for 64%). In the period of 2018 - 2022, the Department of Justice arranged and disbursed funds according to the expenditure contents of Resolution No. 33 with an amount of 527 million 268 thousand VND; for Resolution No. 34, the Department did not have the content and expenditure level according to the resolution. However, from 2018 to now, every year, the Provincial People's Committee has allocated about 300 million VND to the Department of Justice to perform its tasks.
The Department recommends: The Ministry of Finance, the Ministry of Justice and relevant ministries and branches promptly issue circulars amending and supplementing Joint Circular No. 14 and Joint Circular No. 100 guiding the preparation of estimates, management and settlement of State budget funds to ensure legal dissemination and education work and standards of people's access to the law, and mediation work at the grassroots level. The Provincial People's Council and People's Committee direct agencies, units and localities to arrange funds for legal dissemination and education work, standards of legal access and mediation at the grassroots level according to the decentralization of state management. Pay attention to and allocate funds to the Department of Justice to perform the tasks of propaganda and legal dissemination. Amend, supplement or replace resolutions after the amended and supplemented circulars are issued.
Agencies, units and localities should pay attention to arranging and allocating funds for legal dissemination and education, legal access standards and mediation at the grassroots level in the annual State budget estimates assigned according to the provisions of the State Budget Law, implementing documents and instructions of the Department of Finance.
In his concluding remarks, Head of the Legal Committee of the Provincial People's Council Nong Van Tuan requested the Department of Justice to continue to promote its role as a focal point for advising the Provincial Council for Coordination of Legal Education and Dissemination to effectively carry out propaganda, legal dissemination, standards for people's access to the law and mediation at the grassroots level in conjunction with the implementation of local political tasks. Raise awareness of Party committees, authorities and people about the importance and significance of propaganda, legal dissemination and mediation at the grassroots level. Innovate, diversify and develop propaganda contents suitable to the actual situation of the locality and each locality and propaganda object.
Strengthen guidance, training, and fostering of legal knowledge and professional skills in disseminating and popularizing legal knowledge for reporters, propagandists, mediators, and professional staff at the grassroots level; strengthen grassroots mediation organizations; pay attention to fully implementing the regime for the grassroots propaganda team. Continue to consolidate, manage, and effectively exploit legal bookshelves, creating conditions for people to come and learn about the law. Arrange reasonable funding to invest in equipment for disseminating and popularizing legal knowledge, standardizing people's access to the law, and local mediation work.
The delegation received comments and recommendations from the Department of Justice, synthesized them, and forwarded them to competent authorities for consideration and resolution.
