Conference of People's Courts of Vietnam - China border provinces: Strengthening judicial cooperation, maintaining border security

On November 28, in Quang Ninh, the Supreme People's Courts of Vietnam and China and border localities held the 2nd Conference, agreeing on many important contents of judicial cooperation. The signing of the Joint Communique between the two sides opens a mechanism for closer coordination in handling cross-border civil, commercial and criminal cases, thereby ensuring the rights of the people and enhancing stability in the border area.

Maintain stability in border areas and promote Vietnam-China friendly cooperation

At the meeting, the Chief Justices of both sides affirmed that cooperation between the Supreme People's Courts of the two countries is an important component in the overall relationship between the two Parties and the two countries of Vietnam and China. At the same time, they believed that the judicial cooperation between the two countries would become increasingly substantial, effective and practical, contributing to further strengthening the comprehensive strategic cooperative partnership and promoting the community of shared future between Vietnam and China.

The two sides also affirmed that the People's Court plays a central role in ensuring order, discipline and social stability - the core values ​​of a sustainably developed country. Through independent, objective and strict adjudication, the Court contributes to effectively combating crime and promptly handling violations of the law, thereby maintaining political security and social order and safety.

In addition to the discussion, the Chief Justices of the People's Courts of the two countries shared the results of current judicial reform work and gave their opinions on the proposal for Vietnam to host the fourth China-ASEAN Judicial Forum in 2026.

After the talks, delegates from both sides held a conference and discussed four topics: Assessing the cooperation situation between the People's Courts of border provinces based on the results of the first conference; Experience in adjudicating cases of smuggling and human trafficking across the border in conjunction with the goal of preventing and combating this type of crime; Sharing experiences on dispute resolution mechanisms in court and outside of court; Researching the establishment of a cooperation mechanism for collecting evidence in civil and commercial cases between Vietnam and China.

In his opening remarks, Chief Justice of the Supreme People's Court of Vietnam Nguyen Van Quang emphasized that, in the face of the current complex and unpredictable developments in international and transnational violations and crimes, more than ever, the Courts of the two countries continue to strengthen closer coordination to successfully fulfill their responsibilities, contributing to the development of the special relationship between the two countries and said that today's conference also aims at that goal.

This event is of great significance, marking a milestone for deeper and broader development in the cooperative relationship between the two countries' court systems, and at the same time bringing judicial cooperation to a new level, commensurate with the new connotation and new position of the relationship between our two countries,” said Chief Justice of the Supreme People's Court Nguyen Van Quang.

According to the Chief Justice of the Supreme People's Court of Vietnam, the cooperation activities of the People's Courts of the two countries have been constantly developing at the central and local levels. The close cooperation of the Courts of the two countries to effectively resolve transnational issues in the fields of civil and commercial affairs and coordinate the fight against crime has not only had, is having and will have a positive impact on the development and international integration process of each country but also contributed to maintaining stability in the border area and promoting friendly cooperation between Vietnam and China.

Speaking at the conference, Chief Justice of the Supreme People's Court of China Zhang Jun emphasized that Vietnam-China judicial cooperation has been maintained stably and effectively for many years with increasingly extensive delegation exchanges, experience sharing and professional seminars, and the first conference in 2023 has become a model of cooperation.

The Chief Justice of the Supreme People's Court of China proposed to continue to enhance judicial trust and share trial experience; maintain regular coordination mechanisms, expand cooperation to the field of digital courts, digital transformation, staff training and transform common perceptions into concrete actions through studying and signing cooperation documents, enhancing information sharing and coordinating to solve cross-border crimes.

After the opening session, under the direction of Comrade Pham Quoc Hung, Deputy Chief Justice of the Supreme People's Court of Vietnam and Comrade Ly Dung, Deputy Chief Justice of the Supreme People's Court of China, the delegates exchanged and discussed according to the proposed contents.

Next, in the spirit of consensus and high unanimity, witnessed by the delegates, the Chief Justices of the Supreme People's Courts of Vietnam and China signed a Joint Communique, marking the success of the second Conference of People's Courts of the Vietnam-China border provinces.

Closing the Conference, Chief Justice of the Supreme People's Court Nguyen Van Quang highly appreciated the carefully prepared comments, focusing on sharing experiences and difficulties and problems related to the proposed contents; emphasizing the importance of strengthening and improving the capacity of judges and court officials of the border provinces of the two countries in terms of professional expertise and skills in resolving cases and incidents with foreign elements.

Chief Justice Nguyen Van Quang pledged to continue implementing the contents that the two sides have noted in the Joint Communique as well as the Memorandum of Understanding on cooperation between the Supreme People's Courts of the two countries signed on May 3, 2018.

The Supreme People's Court of Vietnam will guide and encourage provincial-level People's Courts of Vietnam to proactively exchange trial experiences and strengthen coordination with the People's Courts of the same level in China to together fulfill their responsibilities excellently.

I believe that, on the basis of the friendly relationship between the Party, State and People of Vietnam and China, the People's Courts of the two countries will more excellently fulfill their role of "protecting justice, protecting the people", spreading the spirit of "rule of law" more widely, contributing to maintaining security and society in the border provinces" , Chief Justice Nguyen Quang expressed.

The Joint Communiqué of the 2nd Conference of People's Courts of Vietnam - China border provinces stated:

1. This Conference is in line with the need for judicial cooperation between the two Parties to concretize the content of the Memorandum of Understanding on Cooperation between the Supreme People's Courts of the two countries dated May 3, 2018 at the First Conference and to meet practical requirements in the context of increasing crimes of smuggling and human trafficking across the border, increasingly complicated civil and cross-border trade disputes. Thereby, the Conference contributes to deepening the Comprehensive Strategic Cooperative Partnership, promoting the building of a Vietnam-China Community of Shared Future of strategic significance, promoting mutually beneficial cooperation between the two Parties.

2. The Conference highly appreciated the information and experiences that the two sides exchanged on the adjudication of cases of smuggling and human trafficking across the border; and the mechanism for dispute resolution in and out of court in border areas.

3. The Conference affirmed the need to strengthen cooperation in collecting evidence in civil and commercial cases between the two sides. People's Courts of border localities need to study and develop coordination and information sharing mechanisms; support each other in entrusting the collection of evidence and serving of procedural documents in accordance with the laws of each country and international treaties to which the two countries are members in order to promptly resolve difficulties and problems in the process of resolving cross-border civil and commercial cases.

4. The conference affirmed the need to strengthen cooperation in training and fostering the team of judges and court officials of the border provinces of the two countries in professional expertise and skills in resolving cases with foreign elements.

5. The People's Courts of border provinces need to coordinate with relevant agencies to do a good job of propagating and disseminating the laws of each country to the people; raise awareness and promote the role of the people in detecting, fighting and preventing crimes in border areas, especially smuggling and human trafficking, contributing to maintaining security, order and stability in the border areas of the two countries.

6. The Unified Conference of the Supreme People's Court of China shall preside over the organization of the Third Conference of the People's Courts of the Vietnam-China Border Provinces in 2027 in China; assign the international cooperation unit of the two sides to act as the focal point for advising and proposing to the leaders of the Supreme People's Courts of the two countries on specific issues related to the implementation of this Communique.
