The Ministry of Construction 's viewpoint is that all administrative procedures for licensing must be seriously implemented, reviewed, simplified, abolished and maximum conditions created for people, businesses and localities.
Regarding construction permits, in Official Dispatch No. 78/CD-TTg dated May 29, 2025, the Prime Minister clearly directed to focus on reducing and simplifying administrative procedures in the construction sector. First of all, for legal documents related to the construction sector and licensing regulations, the Ministry of Construction will review everything, from the Construction Law to decrees and circulars. Second, the Ministry will conduct a final assessment, because all licensing procedures for people are decentralized to localities.

“We create the most favorable conditions for people and businesses, but we also have to assess the impact. If we remove licensing and allow people to build on their own, will it affect the rights and legitimate interests of other people and businesses?” Deputy Minister Nguyen Danh Huy emphasized.
The Ministry of Construction will adjust, amend, and reduce procedures according to the Construction Law, all of which will be completed in 2025. In the immediate future, areas with approved 1/500 detailed plans can be amended and exempted from licensing immediately. Or areas with urban designs according to the General Law can use that urban design and licensing can be eliminated immediately.
Sharing about the advantages and disadvantages of removing this administrative procedure, the Deputy Minister of Construction said that if a procedure is removed, people will not have to apply for a license, and state management agencies will not have to carry out licensing procedures, saving costs and labor. However, the difficulty and challenge is how to create favorable conditions for people while maintaining the role and ensuring the legitimate rights of other people and households.
“In the situation of crowded streets, how should we manage the land plots that are combined and merged?”, Mr. Huy raised the issue; at the same time, he affirmed that he will continue to evaluate and provide the best solutions for people and businesses.
Previously, on May 29, Prime Minister Pham Minh Chinh signed Official Dispatch No. 78/CD-TTg on focusing on cutting and simplifying administrative procedures in the construction sector. According to the Official Dispatch, feedback from people and businesses showed that the implementation time of some construction investment projects is still long, with many administrative procedures, and the cost of complying with administrative procedures is still high.
In order to reform administrative procedures in the construction sector more strongly, substantially, and drastically, to meet the requirements and directions of the Politburo, the Secretariat, and the Government, the Prime Minister requested the Minister of Construction to cut down on construction permit procedures for construction investment projects with detailed planning at a scale of 1/500 or projects in areas with approved urban designs; continue to study and thoroughly decentralize the authority to handle administrative procedures for project appraisal, design, construction permit issuance, and inspection of acceptance work, in accordance with the arrangement of administrative units and the implementation of a 2-level local government organization model.
People's Committees of provinces and centrally run cities shall proactively monitor and inspect, within their authority, the compliance with laws on construction investment by entities participating in construction investment activities, ensuring state management, social order and safety when implementing the transition from pre-inspection to post-inspection and decentralizing the authority to handle administrative procedures.
