Accordingly, to resolve the regime and policies, for cases of cadres who are not old enough to be re-elected or re-appointed; cadres who are eligible for re-election or re-appointed to the same-level Party Committee, whose working time from the date of the congress is from 2.5 years (30 months) to 5 years (60 months) until the prescribed retirement age, and cadres who are participating in Party Committees in Party Committees that must end their activities and consolidate their organizational apparatus, who have 5 years (60 months) or less until retirement age, who wish to retire before the age and are approved by competent authorities and have a voluntary application for early retirement, it is requested that agencies, units and localities submit their dossiers according to the instructions in Official Dispatch No. 4916 of the Provincial Party Committee's Organization Committee before June 20, 2025 for appraisal and submission to the Standing Committee of the Provincial Party Committee for consideration and comments.

For cadres who meet the age requirements for re-election and reappointment to the same-level Party Committee, whose working time from the date of the congress is more than 5 years (60 months) until the prescribed retirement age, and cadres, civil servants, and public employees (including those who have had a retirement decision or a retirement notice but the retirement date is after the province's merger) who have voluntarily applied for early retirement: Agencies, units, and localities are requested to send their dossiers according to the dossier components stated in Instruction No. 2618/HD-UBND to the Provincial Party Committee's Organization Committee for appraisal and submission to the Provincial Party Committee's Standing Committee for consideration and comments. In particular, note that the Project/Plan for arrangement of cadres, civil servants, public employees, and workers of agencies, units, and localities when implementing mergers and acquisitions must clearly state the reasons for each case where arrangements cannot be made after mergers and acquisitions; At the same time, it is accompanied by a list of subjects expected to be resolved for early retirement and resignation, as a basis for implementing policy and regime resolution.
For those working under the labor contract regime (drivers, janitors, etc.) who signed labor contracts according to Decree No. 68 before January 15, 2019, they can continue to sign labor contracts according to Decree No. 161/2018/ND-CP, Decree No. 111/2022/ND-CP. It is recommended that agencies and units using labor when developing a Project/Plan for arranging cadres, civil servants, public employees and employees of agencies, units and localities when implementing mergers and acquisitions must clearly identify the need to continue using labor or terminate labor contracts, as a basis for evaluating, considering and resolving policies and regimes in accordance with regulations.
In the case of cadres, civil servants, public employees, and workers who voluntarily apply for early retirement or leave work after July 1, 2025, the instructions in Official Dispatch No. 1814 of the Ministry of Home Affairs on the implementation of Decree No. 178 and Decree No. 67 shall be followed. Accordingly, the competent agencies, organizations, and units assigned to receive cadres, civil servants, public employees, and workers shall be responsible for reviewing and resolving policies and regimes in accordance with regulations.
The document also emphasized that, in order to ensure progress and efficiency in the organization of the apparatus after the merger and consolidation, and at the same time, to serve as a basis for resolving policies and regimes for cadres, civil servants, public employees and workers in accordance with regulations, agencies and units are requested to urgently develop and complete the Project/Plan for arranging the staff, civil servants, public employees and workers under their management after the arrangement. Particularly for provincial-level agencies, it is necessary to closely coordinate and unify with agencies and units of Lam Dong and Dak Nong provinces to develop a project to merge provincial-level agencies and units in a synchronous, unified and effective manner, as an important basis for considering and resolving policies and regimes for cadres, civil servants, public employees and workers.
