Continuing the 10th Session, on the morning of November 7, Minister of Construction Tran Hong Minh, authorized by the Prime Minister , presented the draft Law on amending and supplementing a number of articles of the Law on Urban and Rural Planning .
Minister Tran Hong Minh said that the draft law clarifies the relationship with the national planning system to ensure consistency and synchronization with laws such as the revised 2025 Planning Law project, the revised 2025 Land Law project and the draft Resolution of the National Assembly stipulating a number of mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law...
The Law amending and supplementing a number of articles of the Law on Urban and Rural Planning also stipulates the urban and rural planning system in accordance with the organization of two-level local government.
The Minister of Construction said that the law will supplement regulations to meet the requirements of commune-level land use planning when no commune-level land use planning is established; the amendment does not stipulate planning for "areas identified for auction of land use rights according to land law".
This is to agree with the draft Resolution of the National Assembly stipulating a number of mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law.

In his report on the review of the draft law, Chairman of the National Assembly's Economic and Financial Committee Phan Van Mai said that it is necessary to carefully assess the impact of the amendment of the Planning Law which has not yet fundamentally resolved the problems and difficulties, potentially creating new bottlenecks in the implementation process, affecting urban and rural planning.
During the review process, many opinions of the National Assembly's Economic and Financial Committee suggested that the State only approve the general planning and zoning planning (1/2,000), not approve the detailed planning that has ensured all necessary criteria for state management, with a planning period long enough and stable enough to be a tool to guide and guide long-term development.
"If the planning level is simplified in the direction of not making zoning plans but "integrating" zoning plans' contents into the master plan, it will lead to the master plan's contents becoming more complicated, taking more time to make the master plan, potentially creating new difficulties and problems in the implementation process," the review report stated.
The Chairman of the National Assembly's Economic and Financial Committee said that there were also opinions suggesting studying regulations on the basis of development management requirements and the capacity of the People's Committees at the commune level, the People's Committees at the provincial level decentralize and authorize the People's Committees at the commune level to approve zoning plans of the city, in accordance with the reality of some cities developing according to the model of multi-polar, multi-center urban clusters (not depending on the administrative boundaries at the commune level).
Another content is about the authority to approve provincial planning and general city planning, there is no consistency between the draft Law on Planning (amended) and this draft law, in case the provincial planning and general city planning are still established separately.
Mr. Phan Van Mai said that some opinions suggested adjusting the authority to approve the city's master plan under the City People's Committee, in line with the provisions in the draft Law on Planning (amended), to avoid conflicts and contradictions in the process of organization and implementation.
At the same time, it is proposed to review and make corresponding adjustments in Article 41 of the draft law for a number of planning schemes currently stipulating that the Prime Minister has the authority to approve.
