The workshop was organized by the Vietnam Union of Science and Technology Associations (VUSTA) in coordination with the National Assembly's Economic Committee.
In his opening speech, Dr. Le Cong Luong, Deputy Secretary General of the Association, said: The Draft Land Law (amended) dated May 29, 2023, after being received, revised and submitted to the National Assembly in the 5th session of the 15th National Assembly, has received and selected a relatively complete number of contents based on comments from a large number of researchers, scientists and people of all walks of life.
To ensure the consistency, unity, synchronization, suitability and feasibility of the Draft Law, the workshop is an opportunity for scientists and experts to continue to contribute ideas on a number of issues such as: Land use rights of public service units; change of land use purpose; land recovery and compensation, support, resettlement; issuance of Land Use Right Certificates; land managed and used by agricultural and forestry companies... Thereby, proposing solutions to effectively use land resources for the country's socio-economic development.
Speaking at the workshop, Mr. Tran Vu Thanh, Deputy Head of the Economic Department, National Assembly Economic Committee affirmed that the Land Law is a very important law project, complex in nature, and has a very wide range of impacts. Tomorrow (June 21), the National Assembly will spend a whole day discussing this law project in the hall.
According to Mr. Tran Vu Thanh, there are currently some important issues that still have many opinions. Specifically, on the right to choose the form of land allocation and land lease of public service units; land policy for ethnic minorities. In addition, expanding the subjects receiving the transfer of agricultural land use rights, including rice land; principles of planning and land use planning; compensation, support, resettlement when the State reclaims land; Land Fund Development Fund and Land Fund Development Organization; land lease, change of land use purpose...
Expressing his opinion, Dr. Dang Viet Dung, Chairman of the Vietnam Construction Association, said that land use planning is an indispensable component in all planning projects in the planning system. Therefore, the land use planning system in the Draft Law on Land (amended) needs to be unified and comply with the general planning system.
At the same time, according to Mr. Dang Viet Dung, it is necessary to unify the time and common terminology when prescribing the time period determined to serve as a basis for forecasting and calculating socio-economic indicators for the establishment of all levels and types of planning in all types of laws, to facilitate the work of surveying, evaluating and forecasting when developing plans.
From there, Dr. Dang Viet Dung proposed that the Drafting Committee should add to the draft regulations on the time and vision for urban and rural land use planning in accordance with the Law on Urban Planning and the Law on Construction. At the same time, add regulations on urban land, urban construction land, regulations on civil land, non-civil land and other urban land categories to the draft Law.
In addition, according to Mr. Dang Viet Dung, the Drafting Committee also needs to stipulate additional forms of planning consultation, subjects of planning consultation according to planning level, reception and explanation work to ensure good implementation of the task of reviewing planning projects, improving the quality of planning projects, and ensuring transparency in planning implementation.
Sharing at the workshop, Dr. Architect Dao Ngoc Nghiem, Vice President of the Vietnam Urban Development Planning Association, said that in the draft law, a number of issues of public concern have been promptly researched and reviewed, especially land recovery and land price determination... However, approaching from the perspective of planning and management, there are still some shortcomings that need further consideration.
Mr. Dao Ngoc Nghiem said that provincial land use planning and provincial land use plans need to be considered independently, especially in the context of socio-economic development and rapid urbanization in the coming period. In land use planning, it is necessary to pay attention to the requirement of 5-year divergence with land use plans to create convenience and flexibility so that the province can proactively adjust annually based on the framework of regulations for the entire planning period.
