3 types of documents required when borrowing a motorbike from a relative
According to Clause 1, Article 56 of the 2024 Law on Road Traffic Safety and Order, vehicle drivers, even if they do not own the vehicle, are still required to carry the following 3 documents: Vehicle registration (original or certified copy with original for comparison); Driver's license (also known as driving license) appropriate to the type of vehicle being driven; Certificate of compulsory civil liability insurance.
In addition, traffic participants should also carry identification documents such as Citizen Identification Card. For car drivers, a certificate of technical safety inspection and environmental protection (registration certificate) is also required.
Forgetting documents and not having documents: Different penalties
If the required documents cannot be presented, the traffic police can detain the vehicle and handle it according to the law. However, it is necessary to clearly distinguish between the two cases of "forgetting to bring documents" and "not having documents". According to Decree 168/2024/ND-CP, the specific penalties are as follows:
About Driver's License:
- Forgetting to bring: fine from 200,000 - 300,000 VND for motorbikes; 300,000 - 400,000 VND for cars.
- No: fine from 2,000,000 - 8,000,000 VND for motorbikes; 18,000,000 - 20,000,000 VND for cars.
Regarding the Certificate of Compulsory Civil Liability Insurance:
- Forgetting to bring: fine from 200,000 - 300,000 VND for motorbikes; 400,000 - 600,000 VND for cars.
- No: fine from 200,000 - 300,000 VND for motorbikes; 400,000 - 600,000 VND for cars.
About car registration:
- Forgetting to bring the registration certificate will be fined from: 300,000 - 400,000 VND.
- No registration certificate or registration stamp, fine from 4,000,000 - 6,000,000 VND.
Currently, when the databases are connected to the national electronic identification system (VNeID), some paper information can be looked up by traffic police through the identification account. However, not all cases are accepted, and the system also depends on the level of information integration of the individual. To be sure, people should still bring all hard copies of documents according to regulations.
Thus, even if you accidentally forget to bring your documents when driving a car or motorbike on the road, you can be severely punished. Therefore, before getting in the car, the driver needs to check all documents, make sure they are complete and still valid.
