On the morning of June 19, starting the second phase of the 5th session, the National Assembly will discuss in the hall the draft Law on Housing (amended).
In a report explaining the acceptance of previous discussions related to housing ownership, the Ministry of Construction said that this amendment will clearly stipulate that foreign individuals' housing ownership is not linked to land use rights, in accordance with the provisions of Article 5 of the draft Land Law (amended).
The drafting agency also affirmed that it will review the consistency between regulations on home ownership in Vietnam by foreign organizations and individuals to be consistent with the 2013 Land Law. At the same time, it will clarify whether home ownership by foreign individuals is linked to land use rights or not.

Also related to this issue, there is a proposal to strictly regulate the conditions for entry into Vietnam for foreign individuals who are allowed to own houses in Vietnam and ensure consistency with the provisions of the Law on Exit and Entry of Vietnamese Citizens, the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam.
Explaining, the drafting agency affirmed that the regulation allowing foreigners to buy and own houses in Vietnam is not new, this content is inherited from Resolution No. 19/2008/QH12 and the Housing Law 2014.
Synthesized reports from localities show that, up to now, nationwide, there have been 3,533 foreign organizations and individuals (236 organizations, 3,197 individuals) who have purchased and owned houses in Vietnam. The Certificate-issuing agency still issues Certificates to foreign organizations and individuals who are allowed to purchase houses in projects according to regulations.
Regarding foreigners, there are many nationalities, such as Korea, China, Singapore, USA, Australia, Japan... In which, they are mainly concentrated in big provinces and cities such as: Hanoi , Ho Chi Minh City, Bac Ninh, Binh Duong...
Regarding the conditions for purchasing and owning a house, the draft clearly stipulates that one must be allowed to enter Vietnam; comply with the regulations on residence and entry into Vietnam according to the Law on Entry, Exit, Residence and Transit.
The Draft Law also clearly stipulates the subjects that are allowed to buy and own houses in Vietnam, including cases where the subjects are economic organizations with foreign investment capital investing in housing construction in Vietnam or operating in Vietnam.
According to the Ministry of Construction, this regulation aims to create favorable conditions for foreigners to live and invest in working in Vietnam.
In addition, there are also opinions suggesting strict regulations in the direction that only foreigners with Vietnamese nationality can own houses. Explaining, the drafting agency said that this is a policy to encourage foreign investment and at the same time is consistent with the policy of international integration. Therefore, the scope of subjects should not be narrowed.
The Ministry of Construction also believes that it is not necessary to stipulate that foreigners must buy houses through an intermediary organization, because the draft has provided specific and strict regulations.
