The notable content of the Law is the amendment and supplement to Article 19 on the conditions for obtaining Vietnamese nationality. Accordingly, foreign citizens and stateless persons who apply for Vietnamese nationality can obtain Vietnamese nationality if they meet all the conditions prescribed in this Law.
Specifically, have full civil capacity according to the provisions of Vietnamese law, except for minors applying for Vietnamese nationality under their father or mother, minors whose father or mother is a Vietnamese citizen. Along with that, comply with the Constitution and laws of Vietnam; respect the culture, traditions, customs and practices of the Vietnamese people.
Notably, applicants for Vietnamese citizenship must know enough Vietnamese to integrate into the Vietnamese community; be residing permanently in Vietnam; have resided permanently in Vietnam for 5 years or more up to the time of applying for Vietnamese citizenship; and be able to ensure a living in Vietnam.
A person applying for Vietnamese nationality must have a name in Vietnamese or in another ethnic language of Vietnam. In case a person applying for Vietnamese nationality also applies to retain a foreign nationality, he/she may choose a name that combines the Vietnamese name and the foreign name. The name is chosen by the person applying for Vietnamese nationality and is clearly stated in the decision to grant Vietnamese nationality. A person applying for Vietnamese nationality may not obtain Vietnamese nationality if doing so would harm the national interests of Vietnam...
The Law also amends and supplements the name and some clauses of Article 23 on the conditions for regaining Vietnamese nationality. Accordingly, a person who has lost Vietnamese nationality under the provisions of this Law and applies to regain Vietnamese nationality will be considered for regaining Vietnamese nationality. A person applying to regain Vietnamese nationality must take back his/her previous Vietnamese name. In case a person applying to regain Vietnamese nationality also applies to retain foreign nationality, he/she may choose a name that is a combination of Vietnamese name and foreign name. This name must be clearly stated in the decision to regain Vietnamese nationality. A person applying to regain Vietnamese nationality may retain foreign nationality if he/she meets the following conditions and is permittedby the President : Retaining foreign nationality is in accordance with the laws of that country; not using foreign nationality to harm the rights and legitimate interests of agencies, organizations, individuals, or to infringe upon national security, interests, social order and safety of the Socialist Republic of Vietnam.
The Law also amends and supplements Article 38 on the duties and powers of the President regarding nationality. Specifically, the President decides to grant Vietnamese nationality, to restore Vietnamese nationality, to renounce Vietnamese nationality, to revoke Vietnamese nationality, to annul decisions on granting Vietnamese nationality, and to restore Vietnamese nationality. He decides on the negotiation and signing of international treaties on nationality in accordance with the provisions of this Law and the Law on International Treaties...
* On the same morning, the National Assembly also voted to pass a Resolution on piloting the People's Procuracy in initiating civil lawsuits to protect the civil rights of vulnerable groups or to protect public interests.
