DeepSeek has been the target of massive cyberattacks in Europe, and it has also been facing accusations of intellectual property theft and privacy concerns. It has also been difficult to register its trademark, at least in the US, because the company is run by a Chinese national.
DeepSeek trademark registered in the US by a 'Chinese'
According to TechCrunch , DeepSeek recently filed a trademark application with the United States Patent and Trademark Office (USPTO) in hopes of protecting its AI applications, products, and chatbot tools. However, the company encountered a major obstacle when just 36 hours earlier, another company called Delson Group, based in Delaware (USA), filed an application to trademark DeepSeek.
Dispute could affect DeepSeek's future in the US
Delson Group claims it began selling DeepSeek-branded AI products in early 2020. In its filing, the company lists its address as a home in Cupertino and its CEO and founder as Willie Lu. Notably, Willie Lu is a former student at Zhejiang University in China with DeepSeek founder Liang Wenfeng. Lu also describes himself as a retired consulting professor at Stanford University and a consultant to the US Federal Communications Commission (FCC), with much of his career in the wireless industry.
Under US law, the first person to use a trademark is generally considered the rightful owner of that trademark unless it can be shown that the trademark was registered in bad faith. This dispute could have a major impact on DeepSeek's future in the US market.
