The National Assembly decided to grant more special development mechanisms and policies to Ho Chi Minh City.

Before voting for approval, the report on receiving and explaining the draft Resolution of the National Assembly on piloting a number of specific mechanisms and policies for the development of Ho Chi Minh City by the National Assembly Standing Committee (NASC) was presented to the National Assembly.

Notably, regarding the pilot model of urban development in the direction of transport development, there are opinions suggesting to study a wider scope of application to neighboring areas to effectively use additional resources, exploit the added value from land to pay for compensation for site clearance and reinvest in works and projects. The Standing Committee of the National Assembly finds that the opinion of the National Assembly Deputies is reasonable. It is recommended that the Government direct agencies to study and submit to competent authorities for consideration and decision on expanding the scope of application to neighboring areas to effectively use additional resources, exploit the added value from land to pay for compensation for site clearance and reinvest in works and projects as the opinion of the National Assembly Deputies.

There are suggestions to add regulations on responsibilities in compliance with planning and principles to ensure harmony between people's rights and legitimate interests in compensation and site clearance. In response to the opinions of National Assembly deputies, the National Assembly Standing Committee has directed agencies to review and revise the draft Resolution, adding regulations to ensure harmony between people's rights and legitimate interests when their land is recovered.

Regarding investment projects under the public-private partnership (PPP) method, there are opinions suggesting to add the application of the PPP mechanism to both the health and education sectors without applying the norms. In response to the opinions of National Assembly deputies, in order to increase investment attraction, promote social resources, cover both PPP projects in the health and education-training sectors, create initiative for the City in implementing PPP projects, not being bound by the regulation of scale from 100 billion VND or more, the National Assembly Standing Committee requests the National Assembly to allow the regulation in the draft Resolution to assign the Ho Chi Minh City People's Council to decide on the scale of PPP projects in the health, education-training, sports and culture sectors.

Regarding attracting strategic investors to Ho Chi Minh City, many opinions suggested that it is necessary to consider not stipulating in Point a, Clause 8, Article 7 because it may violate international commitments that Vietnam has participated in, creating a bad policy precedent and an unhealthy environment for attracting foreign investment. The Standing Committee of the National Assembly found that the opinions of the National Assembly deputies were reasonable and would like to accept them. Accordingly, the Standing Committee of the National Assembly directed the agencies to review and revise the draft Resolution and not stipulate this content. In case it is necessary to increase the attraction of strategic investors on the basis of compliance with the law and in accordance with the practical situation, Ho Chi Minh City will report to the Government to submit to the competent authority for submission to the National Assembly for consideration and decision.

Regarding the management of science and technology and innovation, there are opinions suggesting considering the exemption of personal income tax and corporate income tax on income from the transfer of capital contributions and capital contribution rights to innovative start-up enterprises. According to the Standing Committee of the National Assembly, in practice, investing in innovative start-up enterprises is a form of venture investment with many risks, so it attracts few resources from investors. In order to create motivation to attract capital flows from investors, thereby encouraging more innovative start-up enterprises, the Standing Committee of the National Assembly believes that the policy of exempting personal income tax and corporate income tax on income from the transfer of capital contributions and capital contribution rights to innovative start-up enterprises is necessary. Therefore, the Standing Committee of the National Assembly requests the National Assembly to allow the regulation of exemption of personal income tax and corporate income tax on income from the transfer of capital contributions and capital contribution rights to innovative start-up enterprises as in the draft Resolution.

Regarding the number of Vice Chairmen of the People's Committees of districts, wards, communes and towns, some opinions suggested consideration because the current State apparatus needs to be streamlined, operate effectively and efficiently with the reduction of the number of deputy positions. The Standing Committee of the National Assembly believes that, according to the classification of administrative units at the district level, Ho Chi Minh City has 3 districts (Can Gio, Hoc Mon, Nha Be) which are grade 2 districts, arranged with 2 Vice Chairmen of the District People's Committees and 48 wards, communes and towns with a population of 50,000 or more are grade 1 wards, communes and towns, arranged with 2 Vice People's Committees of wards, communes and towns. However, in reality, in state management in 3 districts and 48 wards, communes and towns, the number of 2 Vice Chairmen of the District People's Committees, 2 Vice Chairmen of the Ward, Commune and Town People's Committees has not ensured the human resources for leadership, administration and advice to assist the Chairman of the District People's Committee. Therefore, to ensure leadership and management resources, the Standing Committee of the National Assembly requests the National Assembly to allow regulations to increase the number of Vice Chairmen of District People's Committees and Vice Chairmen of People's Committees of wards, communes and towns with a population of 50,000 or more.

Regarding the authority of the City People's Council, there are opinions suggesting that it be implemented in accordance with Resolution 27, with the increase not exceeding 0.8 times the basic salary fund of cadres, civil servants, and public employees under its management. The Standing Committee of the National Assembly believes that this regulation is an inheritance of the regulation in Resolution 54, which has been allowed by the National Assembly to continue to be implemented in Resolution 76, in accordance with the spirit of Resolution 31. In order to continue to motivate the team of cadres, civil servants, public employees, and workers to stick together, contribute, and basically meet the living standards in the City, contributing to actively supporting the development of the whole country, the Standing Committee of the National Assembly requests the National Assembly to allow Ho Chi Minh City to continue implementing this policy. The draft Resolution also clearly stipulates that the increase does not exceed 0.8 times the basic salary fund of cadres, civil servants, public employees, and workers under its management in accordance with Resolution 27.

Regarding the organization of Thu Duc city, accepting the opinions of National Assembly deputies, the National Assembly Standing Committee proposed that the Government direct relevant agencies to research, advise, and propose truly outstanding policies for Thu Duc city to further develop in an appropriate time.

Regarding the implementation organization and implementation provisions, there are opinions suggesting not to specify the specific duration of the pilot. In response to the opinions of the National Assembly deputies, the Standing Committee of the National Assembly has directed to review and revise the regulations in the direction of not specifying the pilot implementation period but assigning the Government to summarize 3 years and 5 years of implementation for the National Assembly to consider and decide. The Standing Committee of the National Assembly has directed the agencies to revise the draft Resolution on the summary and review period similar to other localities that have been allowed to pilot specific mechanisms and policies. Accordingly, summarize 3 years of the implementation of the Resolution and report to the National Assembly at the session at the end of 2026; summarize the implementation of the Resolution and report to the National Assembly at the session at the end of 2028".
